This Act is the

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

Secretary must take into account the following matters:

accept an employment pathway plan under this section; and
21
(b) a proposed employment pathway plan is produced as part of
22
those processes that:
23
(i) contains one or more requirements that the person is
24
required to comply with; and
25
(ii) may contain one or more terms that the person may, but
26
is not required to, comply with; and
27
(c) after deciding the person is satisfied with that proposed
28
employment pathway plan, the person accepts that plan as
29
part of those processes.

(c) the state of the labour market and the transport or other

options available to the person in accessing that market;

(d) the participation opportunities available to the person;
14
(e) the family and caring responsibilities of the person;
15
(f) the length of travel time required to comply with
16
requirements in an employment pathway plan;
17
(g) the financial costs (such as travel costs) of complying with
18
requirements in an employment pathway plan, and the
19
person's capacity to pay for such costs.

40G Employment pathway plans--examples of requirements

Seeking, accepting and undertaking paid work
22
(1) An employment pathway plan under this Subdivision in relation to
23
a person may contain requirements relating to one or more of the
24
following:
25
(a) the person actively seeking paid work in Australia;
26
(b) the person accepting, and being willing to accept, offers of
27
paid work in Australia;
28
(c) the person undertaking, and being willing to undertake, paid
29
work in Australia;
30
except particular paid work that is unsuitable to be done by the

(3) An employment pathway plan under Subdivision A, that is in force

in relation to a person who is receiving a jobseeker payment, must

not require the person to participate in an approved program of
20
work for income support payment if:
21
(a) because of the application of Module G of Benefit Rate
22
Calculator B in section 1068 of the 1991 Act, the person is
23
receiving the jobseeker payment at a rate that has been
24
reduced; or
25
(b) the person is at least 50 years of age and is not a person to
26
whom subsection 28(4) of the 1991 Act applies.

Special benefit
28
(4) An employment pathway plan under Subdivision A, that is in force
29
in relation to a person who is receiving a special benefit, must not
30
require the person to participate in an approved program of work

for income support payment if:

(a) the person is under 18 years of age; or

Exception--misuse of alcohol or another drug

(4) Subsection (2) or (3) does not apply to circumstances wholly or
6
predominantly attributable to the person's misuse of alcohol or
7
another drug, unless the person is a declared program participant.

Examples of relevant circumstances

(5) The Employment Secretary may make a determination under
10
subsection (2) or (3) in relation to a person in circumstances that
11
relate to, but are not limited to, the following:
12
(a) the person having a temporary incapacity resulting in the
13
person being unable to undertake work for at least 8 hours
14
per week, where the person has given the Employment
15
Secretary a certificate of a medical practitioner, in the form
16
(if any) approved by the Employment Secretary, that
17
supports the incapacity being caused by a medical condition
18
arising from sickness or an accident;
19
(b) the person experiencing a marriage or relationship
20
breakdown;
21
(c) the death of an immediate family member of the person;
22
(d) the person having suffered a significant personal crisis;
23
(e) the person having been affected by an emergency, disaster or
24
public health crisis.

Revocation of determination
26
(6) The Employment Secretary may revoke a determination under this
27
section in relation to a person if the Employment Secretary is
28
satisfied in all the circumstances that it is no longer appropriate for
29
the determination to remain in effect.

Later exemptions do not limit this section

(1) A person is not required to satisfy the employment pathway plan

requirements in respect of a period (the

(a) the person makes a claim for a jobseeker payment, parenting

payment, a youth allowance or a special benefit; and
6
(b) the person makes the claim after the death of the person's
7
partner; and
8
(c) if the person was not pregnant when the person's partner

died--the person makes the claim in the period of 14 weeks
10
starting on the day of the death of the partner; and
11
(d) if the person was pregnant when the person's partner died--
12
the person makes the claim:

(i) in the period of 14 weeks starting on the day of the

death of the partner; or

(ii) in the period starting on the day of the death of the
16
partner and ending when the child is born or the person
17
otherwise stops being pregnant;
18
whichever ends later.

The applicable period is the period applicable under paragraph (c)

or (d).

(2) A person is not required to satisfy the employment pathway plan

requirements in respect of a period (the

) if:

(a) the person is receiving a jobseeker payment, parenting

payment, a youth allowance or a special benefit; and

(b) while the person is receiving the payment, allowance or

benefit the person's partner dies; and

(c) if the person was not pregnant when the person's partner

died--the person notifies the Employment Secretary of the

person's partner's death in the period of 14 weeks starting on

the day of the death of the partner; and

(d) if the person was pregnant when the person's partner died--
33
the person notifies the Employment Secretary of the person's

partner's death:

(1) A pregnant woman is not required to satisfy the employment
2
pathway plan requirements for the period that starts 6 weeks before
3
the woman's expected date of confinement and ends on the day on
4
which the woman gives birth to the child (whether or not the child
5
is born alive).
6
(2) If a woman gives birth to a child (whether or not the child is born
7
alive), the woman is not required to satisfy the employment
8
pathway plan requirements for the period that starts on the day on
9
which she gives birth to the child and ends 6 weeks after that day.

40R Persons engaged in work
11
Persons 55 and over
12
(1) A person who has reached 55 years of age is not required to satisfy
13
the employment pathway plan requirements in respect of a period
14
of 2 weeks if:
15
(a) unless paragraph (b) applies--the person:
16
(i) is engaged in approved unpaid voluntary work for an
17
approved organisation for at least 30 hours in that
18
2-week period; or
19
(ii) is engaged, for at least 30 hours in that 2-week period,
20
in a combination of approved unpaid voluntary work for
21
an approved organisation and of paid work that the
22
Secretary regards as suitable; or
23
(iii) is engaged for at least 30 hours in that 2-week period in
24
paid work that the Secretary regards as suitable; or
25
(b) if the person is under 60 years of age and that 2-week period
26
begins before the end of 12 months starting on the day the
27
person starts to receive jobseeker payment or special
28
benefit--the person:
29
(i) is engaged, for at least 30 hours in that 2-week period,
30
in work consisting of a combination of approved unpaid
31
voluntary work for an approved organisation and of at
32
least 15 hours of paid work that the Secretary regards as
33
suitable; or

(3) A person is not required to satisfy the employment pathway plan

requirements in respect of a period of 2 weeks if the person:
12
(a) is the principal carer of at least one child or has a partial
13
capacity to work; and
14
(b) is engaged for at least 30 hours in that 2-week period in paid
15
work that the Secretary regards as suitable.

relation to the person; and

(b) the person is undertaking a rehabilitation program; and
25
(c) the program is intended to enhance the person's ability to
26
work; and
27
(d) the length of the person's participation in the program is, or
28
is likely to be, at least 6 weeks; and
29
(e) the person's participation in the program will, or is likely to,
30
end within the period of 208 weeks after the jobseeker
31
payment commenced to be payable to the person.

(b) the person has commenced the full-time course of education

referred to in paragraph 614(6)(a) of the 1991 Act.

The applicable period is the period during which the payment is

payable to the person because of that subsection.

40T Exceptional circumstances

(1) A person is not required to satisfy the employment pathway plan
14
requirements if the person is included in a class of persons
15
specified in a determination under this section that is in effect.
16
(2) The Employment Secretary may make a determination under this
17
section specifying a class of persons for the purposes of
18
subsection (1).

Employment Secretary is satisfied that exceptional circumstances

exist to justify making the determination.

affecting Australia or one or more parts of Australia.

(5) The Employment Secretary must cause details of the class of

persons and of the exceptional circumstances to be published on

the Employment Department's website.

Employment Secretary's own initiative or on request of the person.

unsuitable
to be done by a person if and only if:

(a) the person lacks the particular skills, experience or

qualifications that are needed to perform the work and no

relevant training will be provided to the person; or

(b) it has been established that there is medical evidence that the
9
person has an illness, disability or injury that would be
10
aggravated by the conditions in which the work would be
11
performed; or
12
(c) the person is the principal carer of one or more children, and
13
does not have access to appropriate care and supervision for
14
the children during:
15
(i) the times when the person would be required to
16
undertake the work; or
17
(ii) reasonable amounts of time that would be needed for
18
the person to travel from the person's home to the place
19
of work and from the place of work to the person's
20
home; or
21
(d) performing the work in the conditions in which the work
22
would be performed would constitute a risk to health or
23
safety and would contravene a law of the Commonwealth, a
24
State or a Territory relating to occupational health and safety;
25
or
26
(e) the terms and conditions for the work would be less generous
27
than the applicable statutory conditions; or
28
(f) commuting between the person's home and the place of work
29
would be unreasonably difficult; or
30
(g) the work would require enlistment in the Defence Force or
31
the Reserves; or
32
(h) the work requires the person to move from a home in a place
33
to a home in another place; or
34
(i) for any other reason, the work is unsuitable to be done by the
35
person.

condition and the condition makes it unreasonable for the

person to accept the offer; or

(f) the acceptance of the offer would jeopardise the current paid

work, or the paid work prospects, of the person's partner; or

(g) the person or the person's partner has a child under the age of
18
16 who is living with them or is living somewhere else in the
19
old area; or
20
(h) the person or the person's partner has significant caring
21
responsibilities in the old area; or
22
(i) the educational, cultural or religious background of the
23
person makes it unreasonable for the person to accept the
24
offer; or
25
(j) it is more appropriate for the person to participate in
26
education or training than to accept the offer; or
27
(k) the person would suffer severe financial hardship if the
28
person were to accept the offer.
29
(3) Without limiting subsection (2), if a person, when seeking paid
30
work through an employment service provider, represents to the
31
provider that the person is willing to undertake work outside the
32
area in which the person's home is situated, the person is taken to
33
have sought work outside that area.

(b) implementing any of Australia's international obligations
17
under the ILO Convention (No. 88) concerning the
18
Organisation of the Employment Service done at San
19
Francisco on 9 July 1948 ([1950] ATS 9), as amended and in
20
force for Australia from time to time;
21
(c) implementing any of Australia's international obligations
22
under the ILO Convention (No. 122) concerning
23
Employment Policy done at Geneva on 9 July 1964 ([1970]
24
ATS 17), as amended and in force for Australia from time to
25
time;
26
(d) implementing any of Australia's international obligations
27
under the ILO Convention (No. 142) concerning Vocational
28
Guidance and Vocational Training in the Development of
29
Human Resources done at Geneva on 23 June 1975 ([1986]

ATS 2), as amended and in force for Australia from time to

(d) an employee within the meaning of section 5 of the

When this clause applies and subclause 3(1) does not

(1) This clause applies, and subclause 3(1) does not apply, in relation

to a person's:

(a) claim for jobseeker payment; or
9
(b) claim for youth allowance that is not based on the person
10
being a new apprentice or undertaking full-time study;
11
if, in relation to that claim, the person enters into an employment
12
pathway plan under section 40E of this Act after the day on which
13
the claim is made.

Note:
Clause 5 may override the start day under this clause in certain
15
circumstances.

(2) Subject to this clause, the start day for the person is the day the
17
person accepted that plan as mentioned in paragraph 40E(1)(c) of
18
this Act.
19
(3) If:
20
(a) in relation to that claim, on a day (the
earlier day
) before the
21
day of that acceptance, the person intended to accept an
22
employment pathway plan as mentioned in
23
paragraph 40E(1)(c) of this Act; and
24
(b) the person failed to accept an employment pathway plan as
25
mentioned in that paragraph on the earlier day; and
26
(c) the person satisfies the Employment Secretary that the failure
27
was because of circumstances beyond the person's control;
28
the start day for the person is:
29
(d) if, in relation to that claim, the day the Employment
30
Secretary notified the person under subsection 40A(3) of this
31
Act of the requirement to enter into an employment pathway
32
plan was on or after the day on which the claim was made--
