The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Social Security Legislation
5
Amendment (Improved Support for Carers) Act 2009.
6
2 Commence ment

This Act commences on 1 July 2009.

38E Disability Care Load Assessment (Child) Determination
14
(1) The Secretary may, by legislative instrument (the Disability Care
15
Load Assessment (Child) Determination):
16
(a) devise a test for assessing the functional ability, behaviour
17
and special care needs of a person aged under 16 (the child),
18
that includes an assessment that must be completed only by a
19
treating health professional; and
20
(b) provide a method for rating the care needs of the child; and
21
(c) provide a method for giving a qualifying rating to a person
22
(the carer) who is caring for the child that takes into account:
23
(i) the care provided for the child by the carer; and
24
(ii) the assessment completed by the treating health
25
professional.
26
(2) If a carer who is caring for a child also cares for one or more other
27
persons (whether or not aged under 16), the Disability Care Load
28
Assessment (Child) Determination may provide a method for
29
giving a qualifying rating to the carer that takes into account:
30
(a) both:
31
(i) the care provided for the child by the carer; and

(ii) the assessment completed by the treating health

professional; and
2
(b) the care provided by the carer for each other person.

38F Treating health professional
4
The Secretary may, by legislative instrument, determine that a
5
person, or any person included in a class of persons, is a treating
6
health professional for the purposes of this Act (other than for the
7
purposes of the Adult Disability Assessment Tool or the Child
8
Disability Assessment Tool).

197A Overview--circumstances in which pe rson is qualified for

carer payme nt
2
(1) The following sections set out the circumstances in which a person
3
is qualified for a carer payment:
4
(a) section 197B (child with a severe disability or severe medical
5
condition);
6
(b) section 197C (2 or more children each with a disability or
7
medical condition);
8
(c) section 197D (disabled adult and one or more children each
9
with a disability or medical condition);
10
(d) section 197E (child who has a terminal condition);
11
(e) section 197F (exchanged care of children);
12
(f) section 197G (short term or episodic care of children);
13
(g) section 197H (extension of short term or episodic care of
14
children);
15
(h) section 198 (disabled adult, or disabled adult and dependent
16
child);
17
(i) section 198AA (hospitalisation).
18
(2) In addition, sections 198AB and 198AC allow a person to continue
19
to qualify for a carer payment in certain short-term circumstances.
20
197B Qualification--child with a severe disability or severe medical
21
condition
22
Child with a severe disability or severe medical condition
23
(1) A person is qualified for a carer payment if:
24
(a) the person personally provides constant care for a person (the
25
care receiver) aged under 16 with a severe disability or
26
severe medical condition; and
27
(b) the person has been given a qualifying rating of intense under
28
the Disability Care Load Assessment (Child) Determination
29
for caring for the care receiver; and
30
(c) a treating health professional has certified in writing that,
31
because of that disability or condition:
32
(i) the care receiver will need personal care for 6 months or
33
more; and

(ii) the personal care is required to be provided by a
1
specified number of persons; and
2
(d) the provision of constant care by the person severely restricts
3
the person's capacity to undertake paid employment; and
4
(e) the requirements of subsections (2), (3) and (4) are met.

Constant care in home
6
(2) The constant care must be provided in a private residence that is
7
the home of the care receiver.
8
Person must be Australian resident
9
(3) The person must be an Australian resident.
10

For Australian resident see section 7.

Care receiver: residence and income and assets tests etc.

(4) The care receiver must:
13
(a) require constant care; and
14
(b) be an Australian resident; and
15
(c) pass the income test under section 198A; and
16
(d) either:
17
(i) pass the assets test under section 198D; or
18
(ii) be the subject of a decision in force under subsection
19
198N(2), (3) or (4) that subparagraph (i) does not
20
disqualify the person providing the constant care from
21
carer payment.

197C Qualification--2 or more children each with a disability or
23
medical condition
24
Children each with a disability or medical condition
25
(1) A person is qualified for a carer payment if:
26
(a) the person personally provides constant care for 2 or more
27
persons (the care receivers) aged under 16 each with a
28
disability or medical condition; and
29
(b) the person has been given a qualifying rating of intense under
30
the Disability Care Load Assessment (Child) Determination
31
for caring for the care receivers; and

(c) in relation to each care receiver--a treating health
1
professional has certified in writing that, because of that
2
disability or condition:
3
(i) the care receiver will need personal care for 6 months or
4
more; and
5
(ii) the personal care is required to be provided by a
6
specified number of persons; and
7
(d) the provision of constant care by the person severely restricts
8
the person's capacity to undertake paid employment; and
9
(e) the requirements of subsections (2), (3) and (4) are met.

Constant care in home
11
(2) The constant care must be provided in a private residence that is
12
the home of the care receivers.

Person must be Australian resident

(3) The person must be an Australian resident.

197D Qualification--disabled adult and one or more children each
28
with a disability or medical condition
29
Disabled adult and one or more children each with a disability or
30
medical condition
31
(1) A person is qualified for a carer payment if:

(a) the person personally provides constant care for both or all of
1
the following persons (the care receivers):
2
(i) a disabled adult who has been assessed and rated under
3
the Adult Disability Assessment Tool and given a score
4
under that assessment tool of at least 20, being a score
5
calculated on the basis of a total professional
6
questionnaire score of at least 8;
7
(ii) one or more persons aged under 16 each with a
8
disability or medical condition; and
9
(b) the person has been given a qualifying rating of intense under
10
the Disability Care Load Assessment (Child) Determination
11
for caring for the care receivers; and
12
(c) in relation to each care receiver who is aged under 16--a
13
treating health professional has certified in writing that,
14
because of that disability or condition:
15
(i) the care receiver will need personal care for 6 months or
16
more; and
17
(ii) the personal care is required to be provided by a
18
specified number of persons; and
19
(d) the provision of constant care by the person severely restricts
20
the person's capacity to undertake paid employment; and
21
(e) the person is not qualified for a carer payment under
22
section 198 because of paragraph 198(2)(a) for caring for the
23
care receiver who is the disabled adult; and
24
(f) the requirements of subsections (2), (3) and (4) are met.
25
Constant care in home
26
(2) The constant care must be provided in a private residence that is
27
the home of the care receivers.
28
Person must be Australian resident
29
(3) The person must be an Australian resident.

(4) The care receivers must:
33
(a) require constant care; and
34
(b) be Australian residents; and

(c) pass the income test under section 198A; and
1
(d) either:
2
(i) pass the assets test under section 198D; or
3
(ii) be the subject of a decision in force under subsection
4
198N(2), (3) or (4) that subparagraph (i) does not
5
disqualify the person providing the constant care from
6
carer payment.
7
197E Qualification--child who has a terminal condition
8
(1) A person is qualified for a carer payment if:
9
(a) the person personally provides constant care for a person (the
10
care receiver) aged under 16; and
11
(b) a medical practitioner certifies in relation to the care receiver
12
that:
13
(i) the care receiver has a terminal condition; and
14
(ii) the average life expectancy for a child with the same or
15
a similar condition is not substantially longer than 24
16
months; and
17
(iii) because of the condition the care receiver will need
18
personal care for the remainder of his or her life; and
19
(iv) the personal care is required to be provided by a
20
specified number of persons; and
21
(c) the provision of constant care by the person severely restricts
22
the person's capacity to undertake paid employment; and
23
(d) the requirements of subsections (3), (4) and (5) are met.
24
(2) Despite paragraph (1)(a), the person remains qualified for a carer
25
payment under this section after the care receiver turns 16 until the
26
earlier of the following:
27
(a) the person no longer otherwise qualifies for a carer payment
28
under this section for caring for the care receiver;
29
(b) the care receiver turns 18.
30
Constant care in home
31
(3) The constant care must be provided in a private residence that is
32
the home of the care receiver.

Person must be Australian resident

(4) The person must be an Australian resident.

Care receiver: residence and income and assets tests etc.

(5) The care receiver must:
5
(a) require constant care; and
6
(b) be an Australian resident; and
7
(c) pass the income test under section 198A; and
8
(d) either:
9
(i) pass the assets test under section 198D; or
10
(ii) be the subject of a decision in force under subsection
11
198N(2), (3) or (4) that subparagraph (i) does not
12
disqualify the person providing the constant care from
13
carer payment.

197F Qualification--exchanged care of children
15
Purpose of section
16
(1) The purpose of this section is to allow a person to qualify under
17
section 197B, 197C, 197D, 197E, 197G or 197H, or a combination
18
of them, for a carer payment for caring for persons who are or
19
include 2 or more persons aged under 16 despite the fact that the
20
person is not personally providing constant care for the same
21
persons.
22
When section applies
23
(2) This section applies if:
24
(a) the person is a parent of 2 or more persons aged under 16;
25
and
26
(b) the person (the carer) is personally providing care for at least
27
2 of those persons (the care receivers); and
28
(c) the care receivers would qualify the carer for a carer payment
29
under section 197B, 197C, 197D, 197E, 197G or 197H, apart
30
from:
31
(i) the fact that the carer is not personally providing
32
constant care for the care receivers; and
33

(ii) the fact that each care receiver has or may have more

than one home; and
2
(d) the circumstances in subsection (3) apply in relation to each
3
of the care receivers.

Circumstances--family law arrangements
5
(3) The circumstances are:
6
(a) under one or more registered parenting plans, parenting plans
7
or parenting orders that are in force, the care receiver is to
8
live with, or spend time with the carer and the care receiver's
9
other parent (whether or not the care receiver is to live with,
10
or spend time with, someone else); and
11
(b) the length or percentage of time (however described) that the
12
care receiver is to live with, or spend time with, the carer and
13
the other parent is specified in, or worked out in accordance
14
with, the plans or orders; and
15
(c) the carer personally provides constant care for the care
16
receiver when the care receiver is living with, or spending
17
time with, the carer; and
18
(d) the carer does not personally provide constant care for the
19
care receiver only because the terms of the plans or orders
20
require the care receiver to live with, or spend time with, the
21
other parent or someone else; and
22
(e) when the carer is not personally providing care for the care
23
receiver, the carer is personally providing care for one or
24
more other care receivers in relation to whom this subsection
25
also applies.
26
Qualification for a carer payment
27
(4) If this section applies, the carer is taken to be qualified for a carer
28
payment under section 197B, 197C, 197D, 197E, 197G or 197H,
29
or a combination of them, for caring for the care receivers or for
30
persons who include the care receivers, as the case requires.
31
Example: The parents of 3 children each with a disability or medical condition
32
are divorced. Under a registered parenting plan covering all 3
33
children, one parent (the first parent) personally provides care in week
34
1 to:
35
(a)
one of the children covered by the plan; and
36
(b)
another child who is similarly disabled but who is not covered by
37
the plan.

The other parent personally provides care for the other 2 children
1
covered by the plan. In week 2, the parents swap care arrangements
2
for the children covered by the plan.

The first parent would not qualify for a carer payment under
4
section 197C because he or she is not providing constant care for the
5
same children. However, this section allows the first parent to qualify
6
for a carer payment for providing care for different children.
7
197G Qualification--short term or episodic care of childre n
8
Secretary's determination
9
(1) The Secretary may determine that a person is qualified for a carer
10
payment for a period if:
11
(a) the person is personally providing constant care for one or
12
more persons (the care receiver or care receivers) each with:
13
(i) a severe disability or severe medical condition; or
14
(ii) a disability or medical condition; and
15
(b) each care receiver is aged under 16 at the start of the period;
16
and
17
(c) in relation to each care receiver--a treating health
18
professional has certified in writing that, because of the
19
severe disability or severe medical condition, or because of
20
the disability or medical condition:
21
(i) the care receiver will need personal care for at least 3
22
months but less than 6 months; and
23
(ii) the care is required to be provided by a specified
24
number of persons; and
25
(d) apart from the fact that the care receiver, or care receivers,
26
will need personal care for less than 6 months, the person
27
would qualify for a carer payment:
28
(i) under section 197B or 197C (whether or not because of
29
section 197F) for caring for the care receiver or care
30
receivers; or
31
(ii) under section 197D (whether or not because of
32
section 197F) for caring for the care receiver and
33
another person.
34
Limits on period determined
35
(2) The period determined by the Secretary:
36
(a) must be 3 months or more and less than 6 months; and
37

(b) must not begin before the person's start day.

Person may remain qualified until end of period even if care
2
receiver turns 16

(3) A person does not cease to be qualified for a carer payment under
4
this section only because the care receiver (or any of them) turns
5
16 before the end of the period determined by the Secretary.

197H Qualification--extension of short term or episodic care
7
Extension of qualification under section 197G
8
(1) This section applies if:
9
(a) a person is qualified for a carer payment for caring for one or
10
more persons (the care receiver or care receivers) aged under
11
16 for a period (the preceding period):
12
(i) under section 197G; or
13
(ii) if this section has previously applied to the person and
14
the care receiver or care receivers--under the most
15
recent application of this section; and
16
(b) in relation to each care receiver--before the end of the
17
preceding period, and before the care receiver (or any of
18
them) turns 16, the person gives the Secretary a certificate
19
from a treating health professional certifying that:
20
(i) because of a severe disability or severe medical
21
condition, or a disability or medical condition, the care
22
receiver will need personal care for a further period of
23
less than 3 months starting immediately after the end of
24
the preceding period; and
25
(ii) the severe disability or severe medical condition, or
26
disability or medical condition, is the same as, or related
27
to, the severe disability or severe medical condition, or
28
disability or medical condition, that necessitated the
29
care for the preceding period; and
30
(iii) the care is required to be provided by a specified
31
number of persons.
32
Person qualified for further period determined by Secretary
33
(2) The person is qualified for a carer payment for a further period if:
34

(a) apart from the fact that the care receiver or care receivers will
1
need personal care for less than 6 months, the person would
2
qualify for a carer payment:
3
(i) under section 197B or 197C (whether or not because of
4
section 197F) for caring for the care receiver or care
5
receivers; or
6
(ii) under section 197D (whether or not because of
7
section 197F) for caring for the care receiver and
8
another person; and
9
(b) the Secretary determines that a carer payment should be
10
granted to the person for the period.
11
(3) The period determined must end not later than 6 months after the
12
first day on which the person started to receive a carer payment
13
under section 197G.
14
Person may remain qualified until end of period even if care
15
receiver turns 16
16
(4) A person does not cease to be qualified for a carer payment under
17
this section only because the care receiver (or any of them) turns
18
16 before the end of the period determined by the Secretary.
19
197J Qualification following qualification for short term or episodic
20
care
21
Purpose of section
22
(1) The purpose of this section is to treat a person as qualified for a
23
carer payment under section 197B, 197C or 197D, or because of
24
197F, for caring for:
25
(a) one or more persons aged under 16; or
26
(b) persons who include one or more persons aged under 16;
27
if, immediately beforehand, the carer was qualified for a carer
28
payment under section 197G or 197H (whether or not because of
29
section 197F) for caring for the person or persons aged under 16.
30
Person taken to be qualified
31
(2) If:

(a) a person is qualified for a carer payment for caring for one or
1
more care receivers aged under 16 for a period (the
2
preceding period):
3
(i) under section 197G; or
4
(ii) if section 197H has applied to the person and the care
5
receiver or care receivers--under the most recent
6
application of that section; and
7
(b) before the end of the preceding period, and before the care
8
receiver (or any of them) turns 16, the person gives the
9
Secretary a certificate in relation to each of them as required
10
by whichever of subsection (3) or (4) applies; and
11
(c) apart from paragraph 197B(1)(c), 197C(1)(c) or 197D(1)(c),
12
the person would be qualified (whether or not because of
13
section 197F) for a carer payment for caring for the care
14
receiver or care receivers or for persons who include at least
15
one of them;
16
the person is taken to qualify under section 197B, 197C or 197D
17
(as the case requires) for caring for the care receiver or care
18
receivers or for persons who include at least one of them.
19
Note:
Paragraphs 197B(1)(c), 197C(1)(c) and 197D(1)(c) require that a
20
treating health professional has certified that the care receiver, or each
21
of them, will need personal care for 6 months or more.
22
(3) If the person was qualified for a carer payment under section 197G
23
or 197H for caring for a care receiver with a severe disability or
24
severe medical condition, there must be a certificate from a treating
25
health professional certifying that:
26
(a) because of a severe disability or severe medical condition the
27
duration of the personal care needed by the care receiver is 6
28
months or more; and
29
(b) the severe disability or severe medical condition is the same
30
as, or related to, the severe disability or severe medical
31
condition that necessitated the care for the preceding period;
32
and
33
(c) the care is required to be provided by a specified number of
34
persons.
35
(4) If the person was qualified for a carer payment under section 197G
36
or 197H for caring for one or more care receivers aged under 16
37
each with a disability or medical condition, there must be a

certificate in relation to each care receiver from a treating health
1
professional certifying that:
2
(a) because of a disability or medical condition, the duration of
3
the personal care needed by the care receiver is 6 months or
4
more; and
5
(b) the disability or condition is the same as, or related to, the
6
disability or condition that necessitated the care for the
7
preceding period; and
8
(c) the care is required to be provided by a specified number of
9
persons.

(5) For the purposes of paragraphs (3)(a) and (4)(a):
11
(a) the 6 months includes any preceding periods under
12
section 197G or under an application of section 197H; and
13
(b) it does not matter if the treating health professional who
14
certified under those sections is the same treating health
15
professional referred to in subsection (3) or (4) or not.
16
197K Remaining qualified for up to 3 months after child turns 16
17
(1) This section applies if:
18
(a) a person is qualified for a carer payment for caring for a care
19
receiver aged under 16 under one of the following provisions:
20
(i) section 197B, 197C or 197D (whether or not because of
21
section 197F);
22
(ii) paragraph 198(2)(d); and
23
(b) the care receiver turns 16; and
24
(c) the care receiver has not been assessed and rated and given a
25
score under the Adult Disability Assessment Tool.
26
(2) If, apart from the care receiver turning 16, the person would remain
27
qualified for a carer payment under that provision, the person
28
remains qualified under that provision for 3 months after the care
29
receiver turns 16.

(1) A person (the carer) is qualified for a carer payment if:

(a) the carer is participating in the care, in hospital, of one of the
19
following persons (the hospitalised person):
20
(i) a disabled adult;
21
(ii) a child with a severe disability or medical condition;
22
(iii) a child with a disability or medical condition;
23
(iv) a child who has a terminal condition;
24
(v) a dependent child of a disabled adult; and
25
(b) it is reasonable to assume that, if the hospitalised person were
26
not in hospital, the carer would qualify, except under
27
section 197G or 197H (whether or not because of
28
section 197F), for a carer payment for:
29
(i) the hospitalised person; or
30
(ii) the hospitalised person and another person or persons;

and

(c) a requirement in subsection (2) is met.

(2) For the purposes of paragraph (1)(c), the requirements are that
2
either:
3
(a) the hospitalised person is terminally ill; or
4
(b) it is reasonable to expect that, upon leaving hospital, the
5
hospitalised person:
6
(i) will reside in a private residence that is the home of the
7
hospitalised person; or
8
(ii) if the carer would qualify for a carer payment because
9
of section 197F for the hospitalised person--will reside
10
in a private residence that is a home of the hospitalised
11
person.

Limit on qualification under subsection (1)
13
(3) However, the period, or the sum of the periods, for which the carer
14
can be qualified under subsection (1) for a hospitalised person who
15
is a disabled adult is 63 days in any calendar year.
16
Note:
There is no limit under subsection (1) for a hospitalised person who is
17
a child.

Short term or episodic care of child (qualified under section 197G
19
or 197H)
20
(4) A person (the carer) qualifies for a carer payment if:
21
(a) the carer is participating in the care, in hospital, of one of the
22
following persons (the hospitalised person):
23
(i) a child with a severe disability or medical condition;
24
(ii) a child with a disability or medical condition; and
25
(b) the Secretary determines in writing that, if the hospitalised
26
person were not in hospital, the carer would qualify under
27
section 197G or 197H (whether or not because of
28
section 197F) for a carer payment for a period or periods for:
29
(i) the hospitalised person; or
30
(ii) the hospitalised person and another person or persons;
31
and
32
(c) it is reasonable to expect that, upon leaving hospital, the
33
hospitalised person:
34
(i) will reside in a private residence that is the home of the
35
hospitalised person; or

(ii) if the carer would qualify for a carer payment because

of section 197F for the hospitalised person--will reside
2

However, the period, or the sum of the periods, for which the carer
5
can be qualified under this subsection for the hospitalised person
6
must not exceed the period, or the sum of the periods, determined
7
under paragraph (b).

(5) A person (the carer) qualifies for a carer payment if:
9
(a) the carer is participating in the care, in hospital, of one of the
10
following persons (the hospitalised person):
11
(i) a child with a severe disability or medical condition;
12
(ii) a child with a disability or medical condition; and
13
(b) immediately before the carer began participating in that care,
14
the carer was qualified under section 197G or 197H (whether
15
or not because of section 197F) for a carer payment for a
16
period for:
17
(i) the hospitalised person; or
18
(ii) the hospitalised person and another person or persons;
19
and
20
(c) the person would cease to be qualified under section 197G or
21
197H for a carer payment for the balance of the period only
22
because the person is participating in the care of the
23
hospitalised person in hospital; and
24
(d) it is reasonable to expect that, upon leaving hospital, the
25
hospitalised person:
26
(i) will reside in a private residence that is the home of the
27
hospitalised person; or
28
(ii) if the carer would qualify for a carer payment because
29
of section 197F for the hospitalised person--will reside
30
in a private residence that is a home of the hospitalised
31
person.

However, the period, or the sum of the periods, for which the carer
33
can be qualified under this subsection for the hospitalised person
34
must not exceed the balance of the period referred to in
35
paragraph (c).

(a) who was qualified for a carer payment under either of the

subclause (1); or
