The Parliament of Australia enacts:

1 Short title

This Act is the
Transport Security Amendment (Serious Crime) Act
5
2019.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

38AA Purpose of this Division

The purpose of this Division is to prevent the use of aviation in

connection with serious crime.

38AB Requirements relating to access to areas and zones

(1) The regulations may, for the purposes of preventing the use of
23
aviation in connection with serious crime, prescribe requirements
24
in relation to areas and zones established under this Part.

(2) Without limiting the matters that may be dealt with by regulations

made under subsection (1), the regulations may deal with the
2
following:

(a) access to areas and zones (including conditions of entry, the
4
issue and use of security passes and other identification
5
systems);
6
(b) the security checking (including background checking) of
7
persons who have access to areas and zones.
8
(3) Regulations made under this section may prescribe penalties for
9
offences against those regulations. The penalties must not exceed:
10
(a) for an offence committed by an airport operator or an aircraft
11
operator--200 penalty units; or
12
(b) for an offence committed by an aviation industry participant,
13
other than a participant covered by paragraph (a) or (c)--100
14
penalty units; or
15
(c) for an offence committed by an accredited air cargo agent or
16
any other person--50 penalty units.

Omit "aviation," substitute "aviation or preventing the use of aviation in
19
connection with serious crime (or both),".

(8) This Act also has the effect that it would have if its operation were

113E Purpose of this Division

The purpose of this Division is to prevent the use of maritime

transport or offshore facilities in connection with serious crime.

113F Requirements relating to access to zones

(1) The regulations may, for the purposes of preventing the use of
21
maritime transport or offshore facilities in connection with serious
22
crime, prescribe requirements in relation to zones established under
23
this Part.
24
(2) Without limiting the matters that may be dealt with by regulations
25
made under subsection (1), the regulations may deal with the
26
following:
27
(a) access to zones established under this Part (including
28
conditions of entry, the issue and use of security passes and
29
other identification systems);

(3) Regulations made under this section may prescribe penalties for
