The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Transport Safety Investigation
6
Amendment (Incident Reports) Act 2010.

2 Commencement
8
This Act commences on the day after it receives the Royal Assent.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

1 After section 19

Add:

19A Interference with reports
6
(1) A person commits an offence if the person, by any improper
7
means, attempts to influence a responsible person with knowledge
8
of an immediately reportable matter or a routinely reportable
9
matter in respect of any report made or required to be made under
10
this Division.
11
Penalty: Imprisonment for 24 months.
12
(2) A person commits an offence if the person inflicts any penalty
13
upon, or deprives of any benefit to, a responsible person with
14
knowledge of an immediately reportable matter or a routinely
15
reportable matter in respect of:
16
(a) the responsible person making any report under this Division;
17
(b) the content of any report made by the responsible person
18
under this Division.

Penalty: Imprisonment for 24 months.
