The Parliament of Australia enacts:

1 Short title
5
This Act is the Timor Sea Maritime Boundaries Treaty
6
Consequential Amendments Act 2019.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

The day the Treaty between Australia and
the Democratic Republic of Timor-Leste
Establishing their Maritime Boundaries in
the Timor Sea done at New York on
6 March 2018 enters into force for Australia.
The Minister must announce, by notifiable
instrument, the day the treaty enters into
force.
3. Schedule 2
A single day to be fixed by Proclamation.
A Proclamation must not specify a day that
occurs before the Greater Sunrise Production
Sharing Contract (within the meaning of the
Treaty between Australia and the
Democratic Republic of Timor-Leste
Establishing their Maritime Boundaries in
the Timor Sea done at New York on
6 March 2018) comes into force.
4. Schedule 3
The day the Treaty between Australia and
the Democratic Republic of Timor-Leste
Establishing their Maritime Boundaries in
the Timor Sea done at New York on
6 March 2018 enters into force for Australia.
Note:
This table relates only to the provisions of this Act as originally

enacted. It will not be amended to deal with any later amendments of

this Act.

(3) Despite subsections (1) and (2), if the rules prescribe modifications
13
of this Act, or specified provisions of this Act, for its operation
14
under subsection (1) or (2) in relation to all or part of the Greater

Sunrise special regime area then, so far as this Act would, apart
16
from this subsection, extend to the area or part, it has effect as so
17
modified.

(4) For the purposes of subsection (3), the rules may prescribe
19
different modifications relating to different parts of the Greater
20
Sunrise special regime area.

Extension relating to Greater Sunrise special regime area
22
(5) Despite subsection 13AB(1) of the Seas and Submerged Lands Act
23
1973:
24
(a) an extension of this Act under subsection (1) of this section
25
has effect; and
26
(b) an extension of this Act, or a provision of this Act, because
27
of rules made for the purposes of subsection (2) of this
28
section may (subject to those rules) have effect;

Australia and the Democratic Republic of Timor-Leste

Establishing their Maritime Boundaries in the Timor Sea done at

New York on 6 March 2018, as in force from time to time.

Timor Sea petroleum activities purpose, in relation to goods,
7
means the purpose of the goods being:
8
(a) taken to a resources installation that is attached to the seabed:
9
(i) in the Greater Sunrise special regime area; or
10
(ii) in the Greater Sunrise pipeline international offshore
11
area within the meaning of the Offshore Petroleum and
12
Greenhouse Gas Storage Act 2006; or
13
(iii) above the Bayu-Undan Gas Field within the meaning of
14
the Timor Sea Maritime Boundaries Treaty; or
15
(iv) in the Bayu-Undan pipeline international offshore area
16
within the meaning of the Offshore Petroleum and
17
Greenhouse Gas Storage Act 2006; or
18
(v) above the Kitan Oil Field within the meaning of the
19
Timor Sea Maritime Boundaries Treaty; and
20
(b) used at the resources installation for a purpose related to
21
Petroleum Activities within the meaning of the Timor Sea
22
Maritime Boundaries Treaty.

(b) a declaration is in force under subsection (2) and the issue of

the permit is within the scope of the agreement to which the
9
declaration relates.

(2) The Minister may, by notifiable instrument, declare that
11
Timor-Leste has notified Australia that Timor-Leste agrees to the
12
issue of permits under this Act in relation to the Greater Sunrise
13
special regime area, either generally or in particular circumstances.

Note:
The declaration can be revoked: see subsection 33(3) of the Acts
15
Interpretation Act 1901.

Limit on inspectors exercising powers

(3) An inspector must not exercise powers under this Act in or above

the Greater Sunrise special regime area in relation to:

unless:

(d) the Minister has first consulted Timor-Leste about the

exercise of powers by inspectors in the Greater Sunrise

Area and outside the Greater Sunrise unit area.

A report by a corporation under section 19 of the National Greenhouse

and Energy Reporting Act 2007 relating to the facility and the financial

year must relate to the:

(a) greenhouse gas emissions; and
15
(b) energy production; and
16
(c) energy consumption;
17
from the operation of the facility for only so much of the
18
pre-commencement period as the facility was under the operational
19
control of the corporation and entities that are members of the
20
corporation's group.

(3)
A report by a corporation under section 22G of the National
22
Greenhouse and Energy Reporting Act 2007 relating to the facility and

the financial year must relate to the:

(a) greenhouse gas emissions; and
25
(b) energy production; and

(c) energy consumption;

To avoid doubt, the new licence may be terminated, varied, surrendered

or cancelled, and the conditions to which it is subject may be varied,

under the Offshore Petroleum and Greenhouse Gas Storage Act 2006.

Dealings relating to new licence

Any dealings that:

(a) related to Pipeline Licence WA-8-PL, granted on 27 April

(1) This Act applies, in accordance with this section, in relation to the

Greater Sunrise special regime area as if that area were part of the
13
adjacent area in respect of the Northern Territory.

(2) A provision of this Act applying because of subsection (1) applies
15
(despite section 11) only in relation to:
16
(a) Australian nationals who are not nationals or permanent
17
residents of Timor-Leste; and
18
(b) Australian permanent residents who are not nationals or
19
permanent residents of Timor-Leste; and
20
(c) the Commonwealth; and
21
(d) persons who are authorities of the Commonwealth; and
22
(e) the States; and
23
(f) the Territories; and
24
(g) persons who are authorities of the States or Territories; and
25
(h) Australian aircraft; and
26
(i) Australian vessels; and
27
(j) members of crews (including persons in charge) of
28
Australian aircraft and Australian vessels; and
29
(k) persons, aircraft or vessels declared under subsection (3) to
30
be subject to the provision.

(3) The Minister may, by notifiable instrument, declare all or any of

one or more of the following to be subject to a provision of this
2
Act, if the Minister is satisfied that Timor-Leste has agreed to them
3
being subject to the provision as it has effect in relation to a place
4
that is in or above the Greater Sunrise special regime area:
5
(a) nationals of a foreign country who are not nationals or
6
permanent residents of Timor-Leste;
7
(b) aircraft with the nationality of a foreign country other than
8
Timor-Leste;
9
(c) vessels with the nationality of a foreign country other than
10
Timor-Leste;
11
(d) members of crews (including persons in charge) of aircraft or
12
vessels described in paragraph (b) or (c).

(4) Despite subsection (2), a provision of this Act applying because of
14
subsection (1) does not apply in relation to a matter that relates to
15
any of the Petroleum Activities within the meaning of the Treaty
16
between Australia and the Democratic Republic of Timor-Leste
17
Establishing their Maritime Boundaries in the Timor Sea done at
18
New York on 6 March 2018, as in force from time to time.

A petroleum retention lease that was in force under the Offshore

Petroleum and Greenhouse Gas Storage Act 2006 over a block in the

Eastern Greater Sunrise offshore area immediately before the
9
commencement of this item is wholly revoked by this item on its
10
commencement.

Note 1: This item commences only once the Greater Sunrise Production Sharing Contract under
12
the Timor Sea Maritime Boundaries Treaty has come into force. Under Article 4 of
13
Annex B to the treaty, the conditions of the contract must be equivalent to the legal
14
rights held under the retention leases.

Note 2: Division 4 of Part 2.3 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006
16
does not apply in relation to the revocation, because it occurs by force of this item.

Note 3: Under section 471 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006,
18
the Titles Administrator must enter in the relevant Register a memorial of the
19
revocation.

1 Compensation for acquisition of property

(1)
If the operation of this Act would result in an acquisition of property
5
(within the meaning of paragraph 51(xxxi) of the Constitution) from a
6
person otherwise than on just terms (within the meaning of that
7
paragraph), the Commonwealth is liable to pay a reasonable amount of
8
compensation to the person.
9
(2)
If the Commonwealth and the person do not agree on the amount of the
10
compensation, the person may institute proceedings in the Federal Court
11
of Australia or the Supreme Court of a State or Territory for the
12
recovery from the Commonwealth of such reasonable amount of
13
compensation as the court determines.
