The Parliament of Australia enacts:

1  Short title 

4 

 

  This Act is the Veterans' Entitlements Amendment Act 2018. 

5 

2  Commencement 

6 

 

(1)  Each provision of this Act specified in column 1 of the table 

7 

commences, or is taken to have commenced, in accordance with 

8 

column 2 of the table. Any other statement in column 2 has effect 

9 

according to its terms.

53NAA  Matters affecting bereavement payments under this 

13 

Subdivision 

14 

 

  If: 

15 

 

(a)  bereavement payments mentioned in subsection 53K(3), 

16 

53L(4) or 53N(2) are payable to the pensioner in relation to 

17 

the death of the partner; and 

18 

 

(b)  after the partner died, an amount of a pension, or a social 

19 

security pension, to which the partner would have been 

20 

entitled if the partner had not died has been paid under this 

21 

Act or the Social Security Act 1991; and 

22 

 

(c)  the Commission is not satisfied that the pensioner has not had 

23 

the benefit of that amount; 

24 

the following provisions have effect: 

25 

 

(d)  the amount referred to in paragraph (b) is not recoverable 

26 

from the pensioner or from the personal representative of the 

27 

partner, except to the extent (if any) that the amount exceeds 

28 

the amount of the bereavement payments referred to in 

29 

paragraph (a);

(e)  the amount of the bereavement payments referred to in 

1 

paragraph (a) is to be reduced by the amount referred to in 

2 

paragraph (b).

5  Application provision 

4 

Section 53NAA of the Veterans' Entitlements Act 1986, as inserted by 

5 

this Schedule, applies in relation to the following: 

6 

 

(a)  bereavement payments referred to in paragraph 53NAA(a) of 

7 

that Act that became payable on or after 1 January 1996; 

8 

 

(b)  deaths referred to in paragraph 53NAA(a) of that Act that 

9 

occurred on or after 1 January 1996; 

10 

 

(c)  amounts referred to in paragraph 53NAA(b) of that Act that 

11 

have been paid on or after 1 January 1996.
