The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Water Efficiency Labelling and
6
Standards Amendment Act 2010.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect
10
according to its terms.

1 After subsection 19(3)

Insert:

(3A) If the WELS standard requires or permits the products to be
7
registered, the WELS standard may require either or both of the
8
following:
9
(a) that the products comply with requirements relating to
10
plumbing that are contained in a specified document, as in
11
force from time to time (including the Plumbing Code of
12
Australia, or an Act or regulations made by a State or
13
Territory, for example);
14
(b) that a specified type of person or body certifies that the
15
products comply with requirements relating to plumbing that
16
are contained in a specified document, as in force from time
17
to time (including the Plumbing Code of Australia, or an Act
18
or regulations made by a State or Territory, for example).

2 Paragraph 29(c)

Repeal the paragraph, substitute:
21
(c) the product does not satisfy:
22
(i) a minimum water efficiency or minimum general
23
performance requirement that the product is required to
24
satisfy by the WELS standard for products of that kind;
25
or
26
(ii) a requirement under subsection 19(3A).
