1 Short title

This Act is the
Workplace Gender Equality Amendment (Closing

the Gender Pay Gap) Act 2023
.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

15A Agency must publish information for relevant employers--

achieving gender equality in relation to remuneration
4
(1) The Agency must publish aggregate information, for each relevant
5
employer for each reporting period, for the purpose of showing the
6
employer's performance and progress in achieving gender equality
7
in relation to remuneration for the employer's workforce.
8
(2) The information may be published by electronic or other means.
9
(3) The Agency may use information in a public report for the
10
purposes of subsection (1).
11
(4) However, the Agency must not publish information under
12
subsection (1) that discloses, either directly or indirectly:
13
(a) personal information; or
14
(b) other information about the remuneration paid to a specific
15
individual.

16C Certain reports to be given to relevant employer's governing

body

Executive summary reports
3
(1) The CEO of a relevant employer must, after receiving from the
4
Agency an executive summary report for the employer for a
5
reporting period, cause a copy of the report to be given to each
6
member of the employer's governing body (if any).

Industry benchmark reports
8
(2) The CEO of a relevant employer must, as soon as reasonably
9
practicable after receiving from the Agency an industry benchmark
10
report for the employer for a reporting period, cause a copy of the
11
report to be given to each member of the employer's governing
12
body (if any).

Giving reports together
14
(3) If, as at the time a relevant employer receives an industry
15
benchmark report for the employer for a reporting period from the
16
Agency:
17
(a) the employer has received from the Agency an executive
18
summary report for the employer for the period; but
19
(b) copies of the executive summary report have not been given
20
to members of the employer's governing body as mentioned
21
in subsection (1);
22
then the CEO of the employer must cause the copies of the
23
executive summary report to be given to the members of the
24
governing body together with the copies of the industry benchmark
25
report.

34 Gender pay gap information

Section 15A of the
Workplace Gender Equality Act 2012

this Schedule, applies in relation to reporting periods that start on or

after:

(a) for a relevant employer that is not a Commonwealth
6
company or a Commonwealth entity--1 April 2022; or
7
(b) for a relevant employer that is a Commonwealth company or
8
Commonwealth entity--1 January 2023.

35 Minimum standards

(1)
An instrument made under subsection 19(1) of the
Workplace Gender
11
Equality Act 2012
that was in force immediately before the
12
commencement of this item continues in force (and may be dealt with)
13
as if it had been made under subsection 19(1) of that Act as amended by
14
this Schedule.
15
(2)
Subitem (1) does not affect when the instrument referred to in that
16
subitem was made for the purposes of subsection 19(2) of that Act.

36 Director of Workplace Gender Equality

(1)
To avoid doubt, a person who was, immediately before the
19
commencement of this item, holding office as the Director of
20
Workplace Gender Equality continues to hold office, on and after that
21
commencement, as the Chief Executive Officer of the Workplace
22
Gender Equality Agency.
23
(2)
The person does so:
24
(a) on the terms and conditions that were applicable to the
25
person immediately before that commencement; and
26
(b) for the balance of the person's term of appointment that
27
remained immediately before that commencement.
28
(3)
Anything done by, or in relation to, the Director of Workplace Gender
29
Equality before the commencement of this item has effect at and after
30
that commencement as if it had been done by, or in relation to, the
31
CEO.

37 Non-disclosure of confidential information
