Amendments to be Moved on Behalf of the Government

CIVIL AVIATION AMENDMENT BILL 2003


OUTLINE


The Government amendments to the Civil Aviation Amendment Bill 2003 (the Bill) will:

• amend the commencement date of the provisions relating to governance arrangements for the Civil Aviation Safety Authority (CASA), from 1 July 2003 to the date the Bill receives Royal Assent; and

• omit the application and savings provisions relating to the preparation of CASA’s Annual Report for the financial year ending 30 June 2003.

These amendments are necessary as the Bill was not enacted in time for the new governance arrangements to take effect from 1 July 2003.

NOTES ON CLAUSES


Amendment 1 relates to Clause 2, Commencement. The amendment omits “1 July 2003” in each of the table Items 2, 4, 6, 8 and 10, and substitutes that date with “The day on which this Act receives the Royal Assent”.

Amendment 2 relates to Clause 4, Application and savings. The amendment omits subclauses (3) and (4) of Clause 4, which relate to the preparation of the Civil Aviation Safety Authority’s Annual Report for the financial year ending June 2003. These provisions were included in the Bill on the basis that the Board would be abolished on 1 July 2003, making the Director of Aviation Safety responsible for the preparation of the CASA Annual Report for the financial year ending 30 June 2003.
