FEDERAL CIRCUIT COURT OF AUSTRALIA LEGISLATION AMENDMENT BILL 2012 GENERAL OUTLINE 1. This Bill amends the Federal Magistrates Act 1999 and other legislation to rename the Federal Magistrates Court as the `Federal Circuit Court of Australia', and to change the title of Chief Federal Magistrate to `Chief Judge' and Federal Magistrates to `Judge'. 2. On 29 May 2012, the Attorney-General, the Hon Nicola Roxon MP, announced that the name of the Federal Magistrates Court and title of Federal Magistrates would change to better reflect their important role in the judicial system. 3. Since the Federal Magistrates Court commenced operation in 2000 its jurisdiction has expanded and the number and complexity of the cases coming before it have increased. It is the only federal court with a program of regular regional circuits. 4. The Bill will continue the Federal Magistrates Court in existence under the new name of Federal Circuit Court of Australia. The Bill will not alter the jurisdiction or the status of the Federal Magistrates Court and the arrangements under which it operates. Changing the name of the Court is not intended to create a new, separate federal court or change existing arrangements. 5. The Bill will implement the new name of the Court and the new titles for the Chief Federal Magistrate and Federal Magistrates. The title of the Chief Federal Magistrate will change to `Chief Judge' and Federal Magistrates to `Judge'. The Bill will provide for styling of Federal Magistrates under the new title as `Chief Judge (name)' and `Judge (name)'. The Bill will make consequential amendments to statutory position titles associated with the Federal Magistrates Court, such as Registrar of the Federal Magistrates Court and Sheriff of the Federal Magistrates Court. 6. The renaming of the Court and the change in title for the Chief Federal Magistrate and other Federal Magistrates will not alter existing entitlements for Federal Magistrates. The Bill makes consequential amendments to the Judges' Pensions Act 1968, Judges (Long Leave Payments) Act 1979, Maternity Leave (Commonwealth Employees) Act 1973 and Parliamentary Contributory Superannuation Act 1948, to preserve current entitlements. 7. The Bill provides for transitional and saving arrangements, including ensuring the continuity of the Federal Magistrates Court, Federal Magistrates and personnel, and existing arrangements for retired disabled Federal Magistrates. 8. This Bill will operate together with a separate, later Bill that will include consequential amendments for other Commonwealth legislation that references the Federal Magistrates Court and Federal Magistrates. FINANCIAL IMPACT STATEMENT 9. The proposed Bill will not have any significant financial impact on commencement.


STATEMENT OF COMPATIBILITY WITH HUMAN RIGHTS Prepared in accordance with Part 3 of the Human Rights (Parliamentary Scrutiny) Act 2011 Federal Magistrates (Title Changes) Amendments Bill 2012 10. This Bill is compatible with the human rights and freedoms recognised or declared in the international instruments listed in section 3 of the Human Rights (Parliamentary Scrutiny) Act 2011. Overview of the Bill 11. The Bill amends the Federal Magistrates Act 1999 and other legislation to rename the Federal Magistrates Court as the `Federal Circuit Court of Australia', and to change the title of Chief Federal Magistrate to `Chief Judge' and Federal Magistrates to `Judge'. 12. The Bill will not alter the jurisdiction or the status of the Federal Magistrates Court and the arrangements under which it operates. The Bill makes consequential amendments to the Judges' Pensions Act 1968, Judges (Long Leave Payments) Act 1979, Maternity Leave (Commonwealth Employees) Act 1973 and Parliamentary Contributory Superannuation Act 1948, to preserve current entitlements of Federal Magistrates. The Bill will make consequential amendments to statutory position titles associated with the Federal Magistrates Court, such as Registrar of the Federal Magistrates Court and Sheriff of the Federal Magistrates Court. 13. The Bill provides for transitional and saving arrangements, including ensuring the continuity of the Federal Magistrates Court, Federal Magistrates and personnel, and existing arrangements for retired disabled Federal Magistrates. Human rights implications 14. The Bill maintains the existing entitlements of Federal Magistrates and does not make any substantive changes to the terms of the statutory office of Federal Magistrate. The Bill confirms that the offices of the Chief Federal Magistrate and Federal Magistrates are the same offices as the offices of Chief Judge and Judge of the Federal Circuit Court of Australia. The Bill preserves existing arrangements in relation to personnel of the Federal Magistrates Court. For these reasons, the Bill does not engage any of the applicable rights or freedoms. Conclusion 15. The Bill is compatible with human rights and does not raise any human rights issues. 2


NOTES ON CLAUSES Clause 1 - Short title 16. The short title of the Bill, once enacted, will be the Federal Circuit Court of Australia Legislation Amendment Act 2012. Clause 2 - Commencement 17. This clause provides for the commencement of this Act. Sections 1 to 3 will commence on the day this Act receives the Royal Assent. 18. Schedules 1 and 2 will commence on a single day to be fixed by Proclamation. However, if the provisions do not commence within the period of six months, beginning on the day the Act received the Royal Assent, the provisions commence on the day after the end of that period. This will enable the updating of Rules and Regulations in accordance with amendments to be made by this Bill. Clause 3 - Schedule(s) 19. This clause provides that each Act specified in a Schedule to the Bill will be amended or repealed as set out in the Schedules. This clause also provides that each other item in the Bill is to have effect according to its terms. SCHEDULE 1 - AMENDMENTS Federal Magistrates Act 1999 Item 1 - Title 20. This item replaces reference to `Federal Magistrates' with `the Federal Circuit Court of Australia' in the long title of the Act to reflect the new name of the Court. The new long title of the Act will be `an Act relating to the Federal Circuit Court of Australia, and for other purposes'. Item 2 - Section 1 21. This item changes the short title of the Act from the `Federal Magistrates Act 1999' to the `Federal Circuit Court of Australia Act 1999'. The effect of the amendment is to allow the Act to be cited as the Federal Circuit Court of Australia Act 1999 in accordance with the new name of the Court. 22. The note clarifies the operation of section 10 of the Acts Interpretation Act 1901 that, if another amendment of the Act is described by reference to the Federal Magistrates Act 1999, the other amendment has effect after commencement of this item as an amendment of the Federal Circuit Court of Australia Act 1999. 3


Item 3 - Subsection 2(1) 23. This item amends the numbering of subsections in section 2. The reference to `(1)' is not required as Item 4 repeals subsection 2(2). Item 4 - Subsection 2(2) 24. This item repeals subsection 2(2). Subsection 2(2) provides for the commencement of proceedings upon establishment of the Federal Magistrate Court. This consequential amendment will repeal subsection 2(2) as it is no longer necessary because the Court has commenced operation. The intention of the amendments in this Bill is that the Court known as the Federal Magistrates Court will continue in existence under the new title of the Federal Circuit Court of Australia. The amendments in this Bill will not create a new federal court (see General Outline of this Bill). Item 5 - Subsection 3(1) 25. This item amends the main object of the Act. Subsection 3(1) provides that the main object of the Act is to create the Federal Magistrates Court under Chapter III of the Constitution. This consequential amendment will update subsection 3(1) to clarify that the main object of the Act is to `continue in existence the Federal Magistrates Court created under Chapter III of the Constitution as the Federal Circuit Court of Australia'. 26. The intention of the amendments in this Bill is that the Court known as the Federal Magistrates Court will continue in existence under the new title of the Federal Circuit Court of Australia. The amendments in this Bill will not create a new federal court (see General Outline of this Bill). Item 6 - Paragraphs 3(2)(a) and (b) 27. This item updates reference to the `Federal Magistrates Court' to be `Federal Circuit Court of Australia' in paragraphs 3(2)(a) and (b) . Paragraphs 3(2)(a) and (b) set out other objects of the Act, which are in addition to the main object in subsection 3(1). This consequential amendment will update paragraphs 3(2)(a) and (b) in accordance with the new name of the Court. Item 7 - Section 4 28. This item repeals the simplified outline of the Act in section 4 and replaces it with an updated outline. The simplified outline of the Act in section 4 provides a general summary of the Act in plain language to give an overview of the operation of the Act. This consequential amendment will update the outline in accordance with the new name of the Court. 29. The new simplified outline reflects the intention of the amendments in this Bill is that the Court known as the Federal Magistrates Court will continue in existence under the new title of the Federal Circuit Court of Australia. The amendments in this Bill will not create a new federal court (see General Outline of this Bill). 4


Item 8 - Section 5 (definition of Chief Executive Officer) 30. This item updates reference to the `Federal Magistrates Court' to be the `Federal Circuit Court of Australia' in the definition of Chief Executive Officer in section 5. Section 5 sets out the definitions of a range of expressions in the Act. Division 2 of Part 7 of the Act provides for the office of Chief Executive Officer of the Court. This consequential amendment will clarify that reference to the Chief Executive Officer is a reference to the Chief Executive Officer of the Federal Circuit Court of Australia, consistent with the new name of the Court. The amendments in this Bill will not create a new statutory office of the Chief Executive Officer (see sub-item 4(1) of Schedule 2 of this Bill). Item 9 - Section 5 31. This item inserts a new definition of `commencement day' in section 5. Section 5 sets out the definitions of a range of expressions in the Act. `Commencement day' will be defined to mean the day on which Schedules 1 and 2 of the Federal Circuit Court of Australia Legislation Amendment Act 2012 commences. This term will be used in a number of locations in the Act to clarify that the Court known as the Federal Magistrates Court immediately before the commencement day will continue in existence under the new title of the Federal Circuit Court of Australia. Clause 2 of this Bill provides for commencement. Item 10 - Section 5 (definition of Commonwealth superannuation contribution) 32. This item updates reference to `Federal Magistrate or retired disabled Federal Magistrate' to be `Judge or retired disabled Judge' in the definition of `Commonwealth superannuation contribution' in section 5. This consequential amendment will update the definition of `Commonwealth superannuation contribution' to reflect the new title of Federal Magistrates as `Judge'. Item 11 - Section 5 (definition of Commonwealth superannuation contribution) 33. This item updates reference to ``Magistrate's' to be `Judge's' in the definition of `Commonwealth superannuation contribution' in section 5. This consequential amendment will update the definition of `Commonwealth superannuation contribution' to reflect the new title of Federal Magistrates as `Judge'. Item 12 - Section 5 (definition of Division) 34. This item updates reference to `Federal Magistrates Court' to be `Federal Circuit Court of Australia' in the definition of `Division' in section 5. `Division' in section 5 means the General Division or the Fair Work Division of the Federal Magistrates Court. This consequential amendment will replace references to reflect the new name of the Court. The amendments in this Bill are intended to be a change of the name of the Court only, and will not alter the arrangement of the business of the Court in Divisions operating before the commencement of the amendments. Item 13 - Section 5 (definition of Federal Magistrate) 35. This item repeals the definition of `Federal Magistrate' in section 5. This consequential amendment will remove the definition of `Federal Magistrate' in the Act. A 5


definition of `Federal Magistrate' in the Act is no longer necessary to reflect the new title of Federal Magistrates as `Judge'. Item 14 - Section 5 36. This item inserts a definition of `Judge' in section 5 to reflect the new title of Federal Magistrates as `Judge' (see Item 31). The term `Judge' when used in the Act will be defined to mean a Judge (including the Chief Judge) holding office under this Act, and, when used in the expression `the Federal Circuit of Australia or a Judge', will mean a Judge sitting in chambers. 37. This item is designed to reflect a change of title of Federal Magistrates only, and is not designed to alter the status of judicial officers of the Court. Item 15 - Section 5 (definition of prior judicial service) 38. This item inserts `Judge, means service, prior to the Judge's appointment as a Judge' to be `Federal Magistrate, means service, prior to the Magistrate's appointment as a Federal Magistrate' in the definition of `prior judicial service' in section 5. This consequential amendment will update the definition of `prior judicial service' in section 5 to reflect the new title of Federal Magistrates as `Judge'. 39. This item is designed to reflect a change of title of Federal Magistrates only, and is not designed to alter the entitlements of judicial officers of the Court. Item 16 - Section 5 (paragraph (c) of the definition of prior judicial service) 40. This item replaces references to `Federal Magistrate' as `Judge of the Federal Circuit Court of Australia' in paragraph 5(c) of the definition of `prior judicial service'. This item is designed to reflect a change of title of Federal Magistrates only, and is not designed to alter the entitlements of judicial officers of the Court or retired disabled judges. Item 17 - Section 5 (note at the end of the definition of prior judicial service) 41. This item replaces the phrase `Magistrate was appointed as a Federal Magistrate' to be `Judge was appointed as a Judge' in the note to the definition of `prior judicial service' in section 5. The note, as amended, will refers to the operation of section 5A in circumstances where a Judge of the Federal Circuit Court of Australia was appointed as a Judge more than once, consistently with the previous approach to Federal Magistrates. Item 18 - Section 5 (definition of Registrar) 42. This item updates reference to the `Federal Magistrates Court' for the `Federal Circuit Court of Australia' in the definition of `Registrar' in section 5. `Registrar' is currently defined as `Registrar of the Federal Magistrates Court'. This consequential amendment will update the definition of `Registrar' to reflect the new name of the Court. Registrar will mean Registrar of the Federal Circuit Court of Australia. 6


Item 19 - Section 5 (definition of retired disabled Federal Magistrate) 43. This item repeals the definition of `retired disabled Federal Magistrate' in section 5. The definition of `retired disabled Federal Magistrate' is no longer necessary because of the change in title of Federal Magistrates. This term will be replaced by the term `retired disabled Judge' (see Item 20) Item 20 - Section 5 44. This item inserts a definition of `retired disabled Judge' in section 5. This consequential amendment will replace the definition of `retired disabled Federal Magistrate'. `Retired disabled Judge' will mean a person certified by the Minister to be a retired disabled Judge under paragraph 9A(2)(a) of the Act. This is consistent with the previous approach to Federal Magistrates, and is not designed to alter the entitlements for retired judicial officers of the Court. Item 21 - Section 5 (definition of retires) 45. This item updates references to `Federal Magistrate' for `Judge' wherever it occurs in the definition of `retires' in section 5, in accordance with the new title of Federal Magistrates as `Judge'. Item 22 - Section 5A 46. This item repeals section 5A and inserts a revised provision that reflects the new title of Federal Magistrates. New section 5A clarifies the operation of the definition of `prior judicial service' in section 5 in the event that a retired disabled Federal Magistrate was appointed more than once. This consequential amendment will substitute a revised section 5A to reflect the new title of Federal Magistrates as `Judge'. New section 5A is consistent with the previous approach to Federal Magistrates, and is not designed to alter the entitlements for retired disabled Federal Magistrates. Item 23 - Part 2 (heading) 47. This item repeals the current heading to Part 2 of the Act and inserts the new heading: `Part 2 - Federal Circuit Court of Australia'. This consequential amendment will insert a new heading to Part 2 to reflect the new name of the Court. Item 24 - Section 8 (heading) 48. This item repeals the heading to section 8 and inserts the new heading: `8 Creation of Federal Circuit Court of Australia'. This consequential amendment will insert a new heading to section 8 to reflect the new name of the Court. Item 25 - Subsection 8(1) 49. This item repeals subsection 8(1) and substitutes a new subsection 8(1). Subsection 8(1) creates the Federal Magistrates Court as a federal court. New subsection 8(1) will provide that the federal court known immediately before the commencement day as the Federal Magistrates Court is continued in existence as the Federal Circuit Court of Australia. 7


50. Federal courts are created in accordance with Chapter III of the Constitution. New subsection 8(1) does not create a new federal court and does not abolish the Federal Magistrate Court that was in existence immediately prior to the change of name of the Court. The intention of the amendments in this Bill is that the Court known as the Federal Magistrates Court will continue in existence under the new title of the Federal Circuit Court of Australia. Item 26 - Subsection 8(2) 51. This item repeals subsection 8(2). Subsection 8(2) states that the Federal Magistrates Court may also be known as the Federal Magistrates Service or the Federal Magistrates Court of Australia. The alternative names of the Federal Magistrate Court in subsection 8(2) are no longer necessary under the new title of the Federal Circuit Court of Australia. Item 27 - Subsection 8(3) 52. This item updates reference to the `Federal Magistrates Court' to be the `Federal Circuit Court of Australia' in subsection 8(3). Subsection 8(3) provides that the Federal Magistrates Court is a court of record and court of law and equity. This consequential amendment will update subsection 8(3) to reflect the new name of the Court. This consequential amendment will not alter the status or jurisdiction of the Federal Magistrates Court (see General Outline of this Bill). Item 28 - Subsection 8(4) 53. This item updates reference to the `Federal Magistrates Court' to be the `Federal Circuit Court of Australia' in subsection 8(4). Subsection 8(4) provides for the judicial officers of the Federal Magistrates Court. This consequential amendment will update subsection 8(4) to reflect the new name of the Court. Item 29 - Subsection 8(4) 54. This item removes reference to `justices' in subsection 8(4). Subsection 8(4) provides that the Federal Magistrates Court consists of `justices'. The amendments in this Bill will change the title of Federal Magistrates to `Judge'. Federal Magistrates will continue to be a judge appointed under Chapter III of the Constitution as reflected in the note at the end of section 8. Item 30 - Paragraph 8(4)(a) 55. This item changes the title of the `Chief Federal Magistrate' for the new title of `Chief Judge' in paragraph 8(4)(a). Subsection 8(4) provides that the Federal Magistrates Court consists of a Chief Federal Magistrate, and other Federal Magistrates who hold office in accordance with the Act. 56. The amendment will not alter the role of the head of jurisdiction and is a change of title only. A change of title to `Chief Judge' is not intended to alter the entitlements or arrangements currently applying to the Chief Federal Magistrates under a new title. 8


Item 31 - Paragraph 8(4)(b) 57. This item changes the title of `Federal Magistrate' for the new title of `Judge' in paragraph 8(4)(b). Paragraph 8(4)(b) provides that the Federal Magistrates Court consists of the Chief Federal Magistrate and other Federal Magistrates who hold office in accordance with the Act. 58. A change of title to `Judge' is not intended to alter the entitlements currently applying to Federal Magistrates under their new title. Other amendments in this Bill maintain the framework of entitlements and arrangements currently applying for Federal Magistrates. Item 32 - At the end of section 8 (before the note) 59. This item inserts two new subsections at the end of section 8. 60. New subsection (5) provides that the person holding office as the Chief Federal Magistrate immediately before the commencement day continues to hold that office under the title of Chief Judge of the Federal Circuit Court of Australia. 61. New subsection (6) provides that a person holding office as a Federal Magistrate (other than the Chief Federal Magistrate) immediately before the commencement day continues to hold that office under the title of Judge of the Federal Circuit Court of Australia. 62. This item reflects the intention that changes to the title of Chief Federal Magistrate to `Chief Judge' and Federal Magistrate to `Judge' will not create new judicial offices. Item 33 - Section 9 (heading) 63. This item repeals the heading to section 9 and inserts: `Personnel provisions relating to Judges'. This consequential amendment will insert a new heading to section 9 to reflect the new title of Federal Magistrates as `Judge'. Item 34 - Part 3 (heading) 64. This item repeals the heading to Part 3 of the Act and inserts the new heading: `Part 3 - Jurisdiction of the Federal Circuit Court of Australia'. This consequential amendment will insert a new heading to Part 3 to reflect the new name of the Court. Item 35 - Section 10 65. This item updates references to the `Federal Magistrates Court' to be the `Federal Circuit Court of Australia' wherever it occurs in section 10. Section 10 provides for the jurisdiction of the Federal Magistrates Court. This consequential amendment will update section 10 to reflect the new name of the Court. The amendment is not intended to alter the jurisdiction of the Court. 9


Item 36 - Section 10A (heading) 66. This item repeals the heading to section 10A and inserts the new heading: `General and Fair Work Divisions of the Federal Circuit Court of Australia'. This consequential amendment will insert a new heading to section 10A to reflect the new name of the Court. Item 37 - Subsections 10A(1), (2) and (3) 67. This item updates references to the `Federal Magistrates Court' to be the `Federal Circuit Court of Australia' wherever it occurs in subsections 10A(1), (2) and (3). Subsections 10A(1), (2) and (3) establish the General and Fair Work Divisions of the Court. This consequential amendment will update subsections 10A(1), (2) and (3) to reflect the new name of the Court. Item 38 - Subsection 10A(3) (note) 68. This item updates reference to the `Federal Magistrates Court' to be the `Federal Circuit Court of Australia' in the note to subsection 10A(3). This consequential amendment will update the Note to subsection 10A(3) to reflect the new name of the Court. Item 39 - Subsection 10A(4) 69. This item updates reference to the `Federal Magistrates Court' to be the `Federal Circuit Court of Australia' in subsection 10A(4). Subsection 10A(4) provides for the jurisdiction of the Federal Magistrates Court that is to be exercised in the General Division of the Court. This consequential amendment will update subsection 10A(4) to reflect the new name of the Court and is not designed to alter the jurisdiction of the Court. Item 40 - Subsection 10A(5) 70. This item updates reference to `Federal Magistrate' to be `Judge' in subsection 10A(5). Subsection 10A(5) provides for the Chief Federal Magistrate to give directions about allocation of proceedings to a Division where the jurisdiction of the Federal Magistrates Court is required to be exercised in both Divisions of the Court. This consequential amendment will update subsection 10A(5) to reflect the new title of Chief Federal Magistrate as `Chief Judge'. Item 41 - Section 11 (heading) 71. This item repeals the heading to section 11 and inserts the new heading: `Exercise of jurisdiction by single Judge'. This consequential amendment will insert a new heading to section 11 to reflect the new title of Federal Magistrates as `Judge'. Item 42 - Subsection 11(1) 72. This item updates references to the `Federal Magistrates Court' to be the `Federal Circuit Court of Australia' wherever it occurs in subsection 11(1). Subsection 11(1) provides that jurisdiction of the Federal Magistrates Court may be exercised by a single Federal Magistrate. This consequential amendment will update subsection 11(1) to reflect the new name of the Court. 10


Item 43 - Subsection 11(1) 73. This item updates reference to `Federal Magistrate' to be `Judge' in subsection 11(1). Subsection 11(1) provides that jurisdiction of the Federal Magistrates Court may be exercised by a single Federal Magistrate. This consequential amendment will update subsection 11(1) to reflect the new title of Federal Magistrates as `Judge'. Item 44 - Subsection 11(2) 74. This item repeals subsection 11(2) and will insert a revised subsection 11(2) to reflect the new name of the Court and the new title of Federal Magistrates. Subsection 11(2) provides that the Federal Magistrates Court constituted by a Federal Magistrate may sit and exercise jurisdiction even if the Court constituted by another Federal Magistrate is sitting at the same time and exercising the jurisdiction of the Court. This consequential amendment will reflect the new name of the Court and new title of Federal Magistrates and is not designed to alter the jurisdiction of the Court. Item 45 - Section 12 (heading) 75. This item repeals the heading to section 12 and inserts: `Arrangement of business of the Federal Circuit Court of Australia'. This consequential amendment will insert a new heading to section 12 to reflect the new name of the Court. Item 46 - Subsection 12(1) (heading) 76. This item repeals the heading to subsection 12(1) and inserts: `Responsibility of Chief Judge'. This consequential amendment will insert a new heading to subsection 12(1) to reflect the new title of the Chief Federal Magistrate as `Chief Judge'. Item 47 - Subsection 12(1) 77. This item updates reference to `Federal Magistrate' to be `Judge' in subsection 12(1). Subsection 12(1) provides for the responsibility of the Chief Federal Magistrate for ensuring the effective, orderly and expeditious discharge of the business of the Court. This consequential amendment will update subsection 12(1) to reflect the new title of the Chief Federal Magistrate as `Chief Judge' and is not designed to alter the responsibilities of the Chief Judge. Item 48 - Subsection 12(1) 78. This item updates reference to the `Federal Magistrates Court' to be the `Federal Circuit Court of Australia' in subsection 12(1). Subsection 12(1) provides for the responsibility of the Chief Federal Magistrate for ensuring the effective, orderly and expeditious discharge of the business of the Court. This consequential amendment will update subsection 12(1) to reflect the new name of the Court. Item 49 - Subsection 12(2) 79. This item updates reference to the `Chief Federal Magistrate' to be the `Chief Judge' in subsection 12(2). Subsection 12(2) requires the Chief Federal Magistrate to promote the objects of the Act when discharging his or her responsibilities in overseeing the business of 11

This consequential amendment will update clauses 8 and 2 of Schedule 2 to reflect the new title of the Chief Federal Magistrates as `Chief Judge'. Judges (Long Leave Payments) Act 1979 Item 403 - Title 467. This item replaces `Federal Magistrates' with `Judges of the Federal Circuit Court of Australia' in the long title to the Act. The effect of the amendment is to exclude Judges of the Federal Circuit Court of Australia from the scope of the Judges (Long Leave Payments) Act 1979. This is intended to maintain the exclusion of Federal Magistrates under their new title from the operation of the Judges (Long Leave Payments) Act 1979. Item 404 - Section 3 (paragraph (a) of the definition of Judge) 468. This item updates reference to `Federal Magistrates' with `Judges of the Federal Circuit Court of Australia' in the definition of `Judge' in section 3. Section 3 provides for definitions used in the Act. 469. The effect of the amendment is to exclude Judges of the Federal Circuit Court of Australia from the definition of `judge' in section 3. This is intended to maintain the exclusion of Federal Magistrates under their new title from the operation of the Judges (Long Leave Payments) Act 1979. This is consistent with the intention of the Bill to maintain entitlements currently applying to Federal Magistrates under their new title. Judges' Pensions Act 1968 Item 405 - Subsection 4(1) (paragraph (a) of the definition of Judge) 470. This item updates reference to `Federal Circuit Court of Australia' to be `Federal Magistrates Court' in the definition of `Judge' in subsection 4(1). Subsection 4(1) provides for definitions used in the Act. Paragraph (a) of the definition of `Judge' in subsection 4(1) provides that Judge means a Justice or Judge of a federal court (other than the Federal Magistrates Court). 471. The effect of the amendment is to exclude Judges of the Federal Circuit Court of Australia from the definition of `judge' in subsection 4(1). This is intended to maintain the exclusion of Federal Magistrates under their new title from the operation of the Judges' Pensions Act 1968. This is consistent with the intention of the Bill to maintain entitlements currently applying to Federal Magistrates under their new title. 71


Maternity Leave (Commonwealth Employees) Act 1973 Item 406 - Paragraph 5(3)(ba) 472. This item updates reference to `Federal Magistrate' to be `Judge of the Federal Circuit Court of Australia' in paragraph 5(3)(ba). Paragraph 5(3)(ba) provides that the Act does not apply to a person who is a Federal Magistrate. 473. The effect of the amendment is that the Act will not apply to a person who is a Judge of the Federal Circuit Court of Australia. This is intended to maintain the exclusion of Federal Magistrates under their new title from the operation of the Maternity Leave (Commonwealth Employees) Act 1973. This is consistent with the intention of the Bill to maintain entitlements currently applying to Federal Magistrates under their new title. Parliamentary Contributory Superannuation Act 1948 Items 407 and 408 - Subsection 21B(1) (paragraph (b) of the definition of holder of an office of profit under the Commonwealth) & Subsection 21B(1) (paragraph (ba) of the definition of holder of an office of profit under the Commonwealth) 474. Items 407 and 408 are related. These items make amendments to the definition of `holder of an office of profit under the Commonwealth' consequential to the new title of Federal Magistrates as `Judge'. Paragraph 21B(1)(b) will provide that a Justice or Judge of a federal court will fall within the definition `holder of an office of profit under the Commonwealth'. A Judge of the Federal Circuit Court of Australia would be covered by this definition. Paragraph 21B(ba) will be repealed consequential to this amendment. 475. The effect of the amendments is to maintain the position for entitlements currently applying to Federal Magistrates under their new title. The amendments are not intended to alter the application of the Parliamentary Contributory Superannuation Act 1948 in relation to Federal Magistrates under their new title. 72


SCHEDULE 2 - TRANSITIONAL AND SAVING PROVISIONS Part 1 - Definitions Item 1 - Definitions 476. This item provides for definitions used in Schedule 2 of the Bill. `Commencement time' means the time the Schedule commences. `New Act' means the Federal Circuit Court of Australia Act 1999 as in force after the commencement time. `Old Act' means the Federal Magistrate Act 1999 as in force immediately before the commencement time. Part 2 - Continuity of the Federal Magistrates Court, Federal Magistrates and personnel Item 2 - Transitional--change of title of offices of Chief Federal Magistrate and Federal Magistrate 477. Sub-items (1) and (2) confirm that the offices of the Chief Federal Magistrate and Federal Magistrates are the same offices as the offices of Chief Judge and Judge of the Federal Circuit Court of Australia. 478. These sub-items clarify that the change of title to `Judge' and `Chief Judge' do not affect the continuity of the statutory offices. For example, Federal Magistrates will not need to be recommissioned as the office will continue in existence under a new title. Item 3 - Transitional--subsection 25B(1) of the Acts Interpretation Act 1901 479. This item provides that subsection 25B(1) of the Acts Interpretation Act 1901 applies as if the Federal Magistrates Court were a body, and the offices of Chief Federal Magistrate and Federal Magistrates were offices. 480. Subsection 25B(1) of the Acts Interpretation Act 1901 provides that, where an Act alters the name of a body (whether or not the body is incorporated) or alters the name of an office, · the body or office continues in existence under the new name so that its identity is not affected, and · in any Act, instrument, order or process, a reference to the body or the office under the former name shall, except in relation to matters that occurred before the alteration took place, be construed as a reference to the body or the office under the new name. 481. Application of subsection 25B(1) of the Acts Interpretation Act 1901 will clarify that the Court's identity is not affected by the title changes while ensuring the effective transition to the new name of the Court and title of Federal Magistrate. 73


Item 4 - Transitional--officers and staff of the Federal Magistrates Court 482. This item provides for transitional arrangements to ensure officers and staff of the Court will continue and will not be affected by the title changes. 483. Sub-item (1) deals with the office of Chief Executive Officer under section 94 of the Federal Magistrates Act 1999. The person who, immediately before the commencement time, was the Chief Executive Officer of the Federal Magistrates Court continues, after that time, as the Chief Executive Officer of the Federal Circuit Court of Australia. Commencement time is defined in item 1 of Schedule 2 of this Bill. This ensures that current arrangements can continue under the title changes. 484. Sub-item (2) deals with other officers of the Court. A person who, immediately before the commencement time, was an officer of the Federal Magistrates Court as mentioned in paragraph 99(1)(a), (b), (c), (d), (e) or (f) of the old Act continues, after that time, as an officer of the Federal Circuit Court of Australia. Commencement time is defined in item 1 of Schedule 2 of this Bill. Officers of the Court include Registrars, the Sheriff of the Court, Deputy Sheriffs, the Marshal of the Court, Deputy Marshals and family consultants. 485. Sub-item (3) deals with staff of the Court. A person who, immediately before the commencement time, was a member of the staff of the Federal Magistrates Court as mentioned in section 112 of the old Act continues, after that time, as a member of the staff of the Federal Circuit Court of Australia. Commencement time is defined in item 1 of Schedule 2 of this Bill. 486. Item 10 of Schedule 2 of this Bill provides that this Schedule does not limit the operation of section 7 or subsection 25B(1) of the Acts Interpretation Act 1901. Item 5 - Saving--things done by Federal Magistrates Court or Federal Magistrate before commencement time 487. This item is inserted to avoid doubt. It clarifies that the amendments in Schedule 1 of this Bill do not affect the validity of anything done by the Federal Magistrates Court or a Federal Magistrate before the commencement time. The amendments in Schedule 1 of this Bill implement the new name of the Court and new title of Federal Magistrates, and maintain current arrangements of the Court and existing entitlements applying to Federal Magistrates. Commencement time is defined in item 1 of Schedule 2 of this Bill. 488. Item 10 of Schedule 2 of this Bill provides that this Schedule does not limit the operation of section 7 or subsection 25B(1) of the Acts Interpretation Act 1901. Item 3 of Schedule 2 of this Bill provides that subsection 25B(1) of the Acts Interpretation Act 1901 applies as if the Federal Magistrates Court were a body, and the offices of Chief Federal Magistrate and Federal Magistrates were offices. Section 7 of the Acts Interpretation Act 1901 provides for the effect of repeal or amendment of Act. Item 6 - Transitional--Rules of Court 489. Sub-item (1) is inserted to avoid doubt. It clarifies that Rules of Court that were in force under the old Act immediately before the commencement time are taken, after that 74


time, to be Rules of Court covered by section 81 of the new Act. Commencement time is defined in item 1 of Schedule 2 of this Bill. 490. Sub-item (2) confirms that sub-item (1) does not prevent amendment or repeal of the Rules of Court that were in force under the old Act immediately before the commencement time. Part 3 - Retired disabled Federal Magistrates Item 7 - Certification of retired disabled Federal Magistrates 491. Sub-items (1) and (2) deal with circumstances in which a Federal Magistrate has been certified by the Minister as a retired disabled Federal Magistrate before the commencement time. The sub-items clarify that a certification, where made, has effect as if it were a certification under paragraph 9A(2)(a) of Schedule 1 to the new Act that the person is a retired disabled Judge. This item ensures that benefits, to which the retired disabled Federal Magistrate is entitled, continue and are not affected by the title changes. Item 8 - Prior judicial service 492. Sub-items (1) and (2) continue the existing position for the definition of `prior judicial service'. Definitions of prior judicial service under sections 5 and 5A are relevant in calculating pensions for retired disabled Federal Magistrates under clause 9B of Schedule 1 of the Act. Part 4 - Other matters Item 9 - Transitional regulations 493. This item provides for the Governor-General to make regulations prescribing matters of a transitional nature (including prescribing any saving or application provisions) relating to the amendments and repeals made by Schedule 1. This provides for flexibility where transitional, saving or application issues arise that are not covered by Schedule 2 of this Bill in order to ensure effective transition to the new name of the Court and new title of Federal Magistrates. Item 10 - Schedule does not limit operation of section 7 or subsection 25B(1) of the Acts Interpretation Act 1901 494. This item confirms that this Schedule does not limit the operation of section 7 or subsection 25B(1) of the Acts Interpretation Act 1901. 495. Item 3 of Schedule 2 of this Bill provides that subsection 25B(1) of the Acts Interpretation Act 1901 applies as if the Federal Magistrates Court were a body, and the offices of Chief Federal Magistrate and Federal Magistrates were offices. Section 7 of the Acts Interpretation Act 1901 provides for the effect of repeal or amendment of Act. 496. This item clarifies that, where section 7 or subsection 25B(1) of the Acts Interpretation Act 1901 would apply, items in this Schedule are not intended to limit the operation of these provisions. 75
