     ADDENDUM TO THE EXPLANATORY MEMORANDUM

     NORTHERN AUSTRALIA INFRASTRUCTURE FACILITY AMENDMENT
            (EXTENSION AND OTHER MEASURES) BILL 2021

This addendum responds to a request from the Senate Standing Committee for the Scrutiny of
Bills in Scrutiny Digest 6 of 2021, dated 21 April 2021.

In Item 10: Paragraph 7(1)(a) (Functions of the Facility), after paragraph 24, insert:

Terms and conditions regarding the provision of financial assistance under section 96 of the
Constitution are enshrined in Master Facility Agreements (MFAs) entered into by the
Commonwealth, the Facility and each jurisdiction at the time of the Facility's establishment
in 2016. The MFAs were tabled in the Senate on 5 February 2018. They will remain in place
following passage of the Bill. This item does not alter the MFAs.
