TOBACCO ADVERTISING PROHIBITION AMENDMENT BILL

OUTLINE
This Bill amends the Tobacco Advertising Prohibition Act 1992 (the
Act) by addressing the provisions of the Act which allow the Minister to grant
an exemption from the general ban on tobacco advertising at international
sporting or cultural events held in Australia. In order for events to be granted
an exemption, the Minister must be satisfied that the event is of international
significance and would be lost to Australia without such an
exemption.
This Bill removes the discretion to grant such exemption with
effect from 1 October 2006. The right of events that currently receive an
exemption to continue to apply for exemptions would be maintained until 2006,
with no new events to receive an exemption after 1 January 2002. Any event
which receives an exemption in the lead up to the cut off of 1 October 2006 must
be completed before that date. The reason for the phase out period is to allow
international event organisers sufficient time to find alternative sponsorship.
The removal of the discretion to grant exemptions is consistent with a
directive which came into force in the European Union in July 1998 which bans
all forms of tobacco advertising in the European Union. This directive notes
that sponsorship advertising of events or activities organised at world level is
to be banned from 1 October 2006.
There is no financial impact.
NOTES ON CLAUSES
This section cites the short title of the proposed legislation as the
Tobacco Advertising Prohibition Amendment Bill 2000.
This section provides that the Act commences on the day on which it
receives the Royal Assent.

section notes that each Act that is specified in the Schedule is to be as set
out in the applicable items in the Schedule concerned.
This item specifies that events that currently receive an exemption have
the right to continue to apply for exemptions until 2006. No new events can
receive an exemption after 1 January 2002. Any event which receives an
exemption is to be completed prior to 1 October 2006.
