No proceedings shall be commenced against any officer for
anything done in execution of or by reason of his or her office until one
month next after notice in writing shall have been delivered to him or her or
left at his or her usual place of abode by the plaintiff, or the
plaintiff's attorney or agent, in which notice shall be clearly stated the
cause and nature of the proceeding and the court in which the same is intended
to be instituted, the name and place of abode of the plaintiff and the name
and place of business of such attorney or agent unless the Supreme Court of a
State, the Supreme Court of the Australian Capital Territory or the Supreme
Court of the Northern Territory of Australia has granted leave to the
plaintiff to proceed without notice, which leave the Court may grant on such
terms as it thinks just.
