CHEQUES ACT 1986 - SECT 113

    A cheque drawn payable to order that:

  (a)   has not been indorsed by the payee; and

  (b)   appears to have been paid by the drawee institution;

is evidence of the receipt by the payee of the sum ordered to be paid by the cheque.
