Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) Subject to subsection ( 2), a cheque is duly presented for payment if a demand for payment of the cheque is made, in accordance with section 62, 62A or 63, on the drawee institution by or on behalf of the holder.
(2) Where a demand for payment of a cheque is made before the date of the cheque arrives, the cheque shall not, by reason of the demand, be taken to have been duly presented for payment.
