COASTAL TRADING (REVITALISING AUSTRALIAN SHIPPING) ACT 2012 - SECT 27

Reporting requirements for general licences

  (1)   A person who holds a general licence at a ny time during a financial year must g ive to the Department a report contain ing the following information relating to the vessel used to engage in coastal trading under the licence during the year:

  (a)   if passengers were carried during the year:

  (i)   the number of passengers carried; and

  (ii)   the ports at which the passengers were taken on board; and

  (iii )   the ports at which the passengers disembarked;

  (b)   if cargo was carried during the year:

  (i)   the kinds and volume of cargo carried; and

  (ii )   the ports at which the cargo was taken on board; and

  (iii )   the ports at which the cargo was unloaded;

  (c )   such other information as is prescribed by the regulations.

  (2)   The report must be given t o the Department no later than 3 0 business days after the end of the financial year to which the report relates.

  (3)   A person contravenes this subsection if:

  (a)   the person holds a general licence at any time during a financial year; and

  (b)   the person fails to give the Department a report containing the information required by subsection   ( 1) within the time required by subsection   ( 2).

Civil penalty:

  (a)   for an individual--50 penalty units; and

  (b)   for a body corporate--250 penalty units.

  (4 )   After the end of each financial year, t he Minister must cause a summary of the information contained in the report s given under subsection   ( 1) in respect of the year to be published on the Department's website.
