Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) The High Court may in any suit order a party to produce any books or writings in his or her possession or power that contain evidence pertinent to any issue in the suit.
(2) If a party fails to comply with an order under subsection (1), the High Court may:
(a) where the party is the plaintiff--dismiss the suit; or
(b) where the party is the defendant--give judgment against the defendant as by default.
