MUTUAL ASSISTANCE IN BUSINESS REGULATION ACT 1992 - SECT 22

Delegation by Minister

  (1)   The Minister may, by signed instrument, delegate to the Secretary of the Department or an APS employee in the Department any of his or her powers or functions under this Act.

  (2)   The Minister may, by signed instrument, delegate any of his or her powers or functions under this Act to:

  (a)   a member (or a member of the board) of a Commonwealth regulator; or

  (aa)   if the Commonwealth regulator is the Australian Securities and Investments Commission -- a senior staff member (within the meaning given by subsection   5(1) of the Australian Securities and Investments Commission Act 2001 ); or

  (b)   a member of the staff of a Commonwealth regulator (other than the Australian Securities and Investments Commission) who:

  (i)   is an SES employee, or acting SES employee; or

  (ii)   is an APS employee who holds, or is acting in, an Executive Level 2 position; or

  (iii)   holds, or is acting in, an office or position that is equivalent to an SES employee, or an Executive Level 2.
