Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) For the purposes of this section 171, the example period for an incapacitated person is the latest period of 2 weeks:
(a) during which the person was continuously engaged in work (as defined in subsection 171(4)); and
(b) ending before the person began his or her last period of continuous full - time service.
(2) However, the Commission may determine as the example period :
(a) a different 2 week period that it considers reasonable; or
(b) a period of a different length that it considers reasonable;
if the pre - CFTS pay for the example period under subsection (1) would
not fairly represent the weekly rate at which the person was being paid for
his or her work before beginning the continuous full - time service.
