Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) The Commission may, in the circumstances and subject to the conditions (if any) prescribed in a legislative instrument made by the Commission for the purposes of this subsection, grant assistance or benefits of the kind, and the amount or value, that it considers reasonable to a person:
(a) who is a member or former member; or
(b) who is or was a dependant of a member, former member or deceased member.
(2) However, the Commission must not grant assistance or benefits in circumstances in which a person:
(a) is entitled to compensation or another benefit under this Act or the Veterans' Entitlements Act 1986 ; or
(b) would be entitled to such compensation or benefit if a claim
was made in respect of the person.
