Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) The Minister or AMSA may exempt from the application of this Act , or s pecified provisions of this Act :
(a) a vessel or class of vessel s; or
(b) a person or class of persons.
(2) An exemption under subsection ( 1) may be confined to one or both of the following:
(a) one or more specified periods;
(b) one or more specified voyages or operations.
(3) An exemption under subsection ( 1) is subject to such conditions (if any) as are specified in the instrument of exemption .
(4) An exemption under subsection ( 1) is not a legislative instrument.
(5 ) A n exemption under subsection ( 1) must not be inconsistent with an obligation of Australia under an international agreement.
(6 ) Before making an exemption under subsection ( 1) ,
the Minist er or AMSA must be satisfied that the exemption will not jeopardise
the safety of a vessel or persons on board a vessel .
