Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) For the purposes of this Act, a facility is a designated large facility for a financial year if:
(a) the total amount of covered emissions of greenhouse gases from the operation of the facility during the financial year has a carbon dioxide equivalence of a particular number of tonnes; and
(b) that number exceeds the number specified in the safeguard rules.
(2) The Minister must take all reasonable steps to ensure that
safeguard rules are in force for the purposes of paragraph (1)(b) at
all times on and after the safeguard commencement day.
