OCCUPATIONAL HEALTH AND SAFETY (MARITIME INDUSTRY) ACT 1993 - SECT 29

Reliance on information supplied--erection or installation of plant

  (1)   In particular, but without limiting what constitutes taking reasonable steps as required by section   22 for the purpose of the application of that section to the erection or installation of plant in a workplace, a person on whom an obligation is imposed under section   22 is taken to have taken such reasonable steps as the section requires, if subsection   ( 2) applies.

  (2)   This subsection applies if:

  (a)   the person ensured, so far as practicable, that the erection or installation of the plant was in accordance with information supplied by the manufacturer or the supplier of the plant relating to the erection or installation of the plant in a manner that ensures the health and safety of employees, contractors or other persons who use the plant; and

  (b)   it was reasonable for the person to rely on that information.
