OFFSHORE PETROLEUM AND GREENHOUSE GAS STORAGE ACT 2006 - SECT 452

Notification of discovery of petroleum in greenhouse gas assessment permit area etc.

Scope

  (1)   This section applies if petroleum is discovered in:

  (a)   a greenhouse gas assessment permit area; or

  (b)   a greenhouse gas holding lease area; or

  (c)   a greenhouse gas injection licence area.

Notification

  (2)   The permittee, lessee or licensee must inform the responsible Commonwealth Minister of the discovery before the end of the 30 - day period that began on the day of completion of the well that resulted in the discovery.

  (4)   Subsection   (2) does not apply if the petroleum is discovered by a petroleum exploration permittee, petroleum retention lessee or petroleum production licensee.

Offence

  (5)   A person commits an offence if:

  (a)   the person is subject to a requirement under subsection   (2); and

  (b)   the person omits to do an act; and

  (c)   the omission breaches the requirement.

Penalty:   100 penalty units.

  (6)   An offence against subsection   (5) is an offence of strict liability.
