ONLINE SAFETY ACT 2021 - SECT 182

Delegation by the Commissioner to a contractor engaged by the Commissioner

  (1)   The Commissioner may, by writing, delegate any or all of the Commis sioner's functions or powers to a person engaged by the Commissioner under subsection   1 85 (1) .

  (2)   A delegate must comply with any written directions of the Commissioner.

  (3)   Subsection   ( 1) does not apply to a power to make, vary or rev oke a legislative instrument.

  (3A)   Subsection   (1) of this section does not apply to a function or power conferred by subsection   2 20A(1) (which deals with the formulation or variation of the internal review scheme).

  (3B)   Subsection   (1) of this section does not apply to a function or power conferred by the internal review scheme (see section   2 20A).

  (4)   Subsection   ( 1) does not apply to a function or power conferred by any of the following provisions:

  (a)   section   4 9 ;

  (b)   section   5 6 ;

  (c)   section   6 5 ;

  (d)   section   6 6 ;

  (e)   section   7 0 ;

  (f)   section   7 7 ;

  (g)   section   7 8 ;

  (h)   section   7 9 ;

  (i)   section   8 3 ;

  (j)   section   8 8 ;

  (k)   section   8 9 ;

  (l)   section   9 0 ;

  (m)   section   9 9 ;

  (n)   section   1 09 ;

  (o)   section   1 10 ;

  (p)   section   1 14 ;

  (q)   section   1 15 ;

  (r)   section   1 19 ;

  (s)   section   1 20 ;

  (t)   section   1 24;

  (u)   section   1 28;

  (v)   section   1 43 ;

  (w)   section   1 54 ;

  (x)   section   1 56;

  (y)   section   1 57 ;

  (z)   section   1 58 ;

  (za)   section   1 59 ;

  (zb)   section   1 94 ;

  (zc)   section   1 99 ;

  (zd)   section   2 00 ;

  (ze)   section   2 03 .

  (5)   Subsection   ( 1) does not apply to a function or power conferred by the Regulatory Powers (Standard Provisions) Act 2014 .
