CIVIL AVIATION SAFETY REGULATIONS 1998 - REG 131.230

Retention periods for personnel records

  (1)   A balloon transport operator contravenes this subregulation   if:

  (a)   the operator is required, under this Part, to make or have a record of a kind mentioned in column 1 of an item of the following table about a person who is a member of the operator's personnel; and

  (b)   the operator does not keep the record for at least the period mentioned in column 2 of the item.

The period beginning when the record is created and ending 5 years after the member ceases to be a member of the operator's personnel

A record required under regulation   131.215 for a member of the operator's personnel who performs ground support duties

The period beginning when the record is created and ending 1 year after the member ceases to be a member of the operator's personnel

A copy of a flight crew member's balloon flight crew licence and medical certificate required by regulation   131.225

The period during which the member is exercising the privileges of the licence for the operator

  (2)   A person commits an offence of strict liability if the person contravenes subregulation   (1).

Penalty:   50 penalty units.
