CIVIL AVIATION SAFETY REGULATIONS 1998 - REG 131.710

What to do if balloon escapes

  (1)   A person contravenes this subregulation   if:

  (a)   the person operates a tethered gas balloon; and

  (b)   the balloon escapes from its mooring; and

  (c)   the balloon is not deflated completely using a deflation device; and

  (d)   the person does not comply with the requirement in subregulation   (2).

  (2)   The requirement is that the person must tell Air Traffic Services as soon as possible:

  (a)   where the balloon was launched; and

  (b)   what time it broke free; and

  (c)   the direction it was headed when last seen.

  (3)   A person commits an offence of strict liability if the person contravenes subregulation   (1).

Penalty:   50 penalty units.
