FEDERAL COURT RULES 2011 - RULE 1.40

    The Court may, at any stage of the proceeding, exercise a power mentioned in these Rules in the proceeding:

  (a)   on its own initiative; or

  (b)   on the application of a party, or a person who has a sufficient interest in the proceeding.
