Commonwealth Consolidated Regulations Commonwealth Consolidated Regulations(1) If an originating application is served on a person outside Australia and the person does not file a notice of address for service within the time fixed by rule 10.43C, the party serving the document may not proceed against the person served except by leave of the Court.
(2) An application for leave under subrule (1) may be made without notice.
