Purpose

To extend the Commonwealth's self insurance arrangements to vehicles which are leased to the Commonwealth.

Background

This Bill arises out of the decision to sell DASFLEET or refinance the fleet of vehicles.Further background in relation to the decision can be found in the Digest of the companion bill, the Commonwealth Vehicles (Registration and Exemption from Taxation) Bill 1997.

Under the Commonwealth Motor Vehicles (Liability) Act 1959 the Commonwealth bears its own liability for third-party claims arising out of the use of motor vehicles ownedby the Commonwealth or a Commonwealth authority where the vehicle is not otherwise insured.

Main Provisions

The amendments contained in Schedule 1 have the effect of extending the self insurance arrangements to vehicles which are leased by the Commonwealth.
