Excise Tariff Amendment Bill (No. 5) 1997

Commencement: The amendments outlined in the Digest are taken to have commenced on 17 September 1997.

Purpose

To impose new rates of excise duty on tobacco and tobacco products.

Background

The reader is referred to the Digest for the States Grants (General Purposes) Amendment Bill (No. 2) 1997.

Main Provisions

Items 1-3 of Schedule 1 insert in the Excise Tariff Act 1921 new rates of excise duty for tobacco and tobacco products. The rate of duty applying to:

• tobacco of a kind for which a wholesale list price is prescribed - $86.92 per kilogram and 50.32% of the wholesale list price;

• tobacco of a kind for which a wholesale list price is not prescribed - $232.17 per kilogram;

• cigars of a kind for which a wholesale list price is prescribed - $86.92 per kilogram and 50.32% of the wholesale list price;

• cigars of a kind for which a wholesale list price is not prescribed - $232.17 per kilogram;

• cigarettes of a kind for which a wholesale list price is prescribed - $86.92 per kilogram and 50.32% of the wholesale list price;

• cigarettes of a kind for which a wholesale list price is not prescribed and there are no more than 1200 cigarettes per kilogram - $232.17 per kilogram;

• cigarettes of a kind for which a wholesale list price is not prescribed and there are more than 1200 cigarettes per kilogram - $350 per kilogram; and

• fine cut tobacco suitable for the manufacture of cigarettes for which a wholesale list price is not prescribed - $232.17 per kilogram.
