AGED CARE (CONSEQUENTIAL PROVISIONS) ACT 1997 No. 114 of 1997 - SECT 37

37 Admission to a nursing home prior to approval
If:

   (a)  before the commencement day, a person is admitted to an approved
        nursing home without the admission being approved under subsection
        40AA(8) or section 40AB of the 1953 Act; and

   (b)  on or after the commencement day, the person is approved under Part
        2.3 of the new Act as a recipient of *residential care; and

   (c)  under subsection 22-5(2) of the new Act, the approval is taken to have
        had effect from the day on which the residential care started; the
        person is to be taken, for the purposes of the 1953 Act, to have been
        approved under subsection 40AA(8) or section 40AB of the 1953 Act on
        the day the person was admitted to the nursing home.
