AGED CARE (CONSEQUENTIAL PROVISIONS) ACT 1997 No. 114 of 1997 - SECT 62

If, immediately before the commencement day:

   (a)  a person is a patient in an approved nursing home (within the meaning
        of the 1953 Act); and

   (b)  the proprietor (within the meaning of the 1953 Act) of the nursing
        home was eligible for the payment of Commonwealth benefits under
        section 48D of the 1953 Act in respect of the person; for the purposes
        of the new Act, a determination is taken to be in force under
        subsection 44-14(2) of that Act that the person is eligible for an
        enteral feeding supplement.
