An amount appropriated under this Act may be applied in making a grant of
financial assistance to:
(a)
a State; or
(b)
a person, or a body, other than a State.
This subsection does not limit the ways in which amounts appropriated under
this Act may be applied.
(2) A grant of financial assistance to a State must be made on such terms and
conditions as are set out in a written agreement between the Commonwealth and
the State.
(3)
A grant of financial assistance to a person, or a body, other than a State
must be made on such terms and conditions as are set out in a written
agreement between the Commonwealth and the person or body.
(4)
An agreement under subsection (2) or (3) may be entered into by any
Minister on behalf of the Commonwealth.
(5)
This Act does not prevent a grant from being a grant by way of bounty.
(6)
Any bounty must be uniform throughout the Commonwealth within the meaning
of paragraph 51(iii) of the Constitution.
(7)
In this section:
"bounty" means bounty to which paragraph 51(iii) of the Constitution applies.
"State" includes the Australian Capital Territory and the Northern Territory.
