A NEW TAX SYSTEM (BONUSES FOR OLDER AUSTRALIANS) ACT 1999 - SECT 14

Grant of proper claim
(1)
The Secretary must determine that a proper claim is to be granted if the Secretary is satisfied that the Family and Community Services customer is qualified for a bonus payment under this Part.

(2)
The Secretary must give written notice of the determination to the customer. The notice must:

(a)
state that he or she is qualified for a bonus payment; and

(b)
specify the amount of the bonus payment and how it was worked out; and

(c)
include a statement to the effect that he or she may apply for a review of the determination under section 1240 of the Social Security Act 1991 , as applied by this Act.

Note: A determination that a Family and Community Services customer is qualified for a bonus payment under this Part is treated in the same way as a determination that a person is qualified for a pension bonus under the Social Security Act 1991 : see section 19.
