(1)

The Secretary may, by writing, delegate all or any of his or her powers and functions under this Act to an SES employee, or acting SES employee, in the Department.

(2)

The Secretary may, by writing, delegate all or any of his or her powers and functions under this Act, other than powers or functions under:

(a)

subsection 71(1); or

(b)

Division 3 of Part 8;

to an APS employee who holds, or is acting in, an Executive Level 2, or equivalent, position in the Department.

(3)

In exercising powers or functions under a delegation, the delegate must comply with any directions of the Secretary.
