BANKRUPTCY AMENDMENT ACT 1980 No. 12 of 1980 - SECT 61
Limitation of time for making claims by trustee, &c.
61. (1) Section 127 of the Principal Act is amended by adding at the end
thereof the following sub-sections:
"(2) An action under sub-section 118 (9) with respect to a charge or charging
order shall not be commenced by the trustee of the estate of a bankrupt after
the expiration of 6 years from the date on which the bankrupt became a
bankrupt.
"(3) An action under section 120 with respect to a settlement, covenant ,
contract, payment or transfer shall not be commenced by the trustee of the
estate of a bankrupt after the expiration of 6 years from the date on which
the bankrupt became a bankrupt.
"(4) An action under section 121 with respect to a disposition of property may
be commenced by the trustee of the estate of a bankrupt at any time.
"(5) An action under section 122 with respect to a conveyance, transfer,
charge, payment or obligation shall not be commenced by the trustee of the
estate of a bankrupt after the expiration of 6 years from the date on which
the bankrupt became a bankrupt.".
(2) Sub-sections 127 (2), (3), (4) and (5) of the Principal Act as amended by
sub-section (1) of this section do not apply in relation to a bankrupt, or the
estate of a bankrupt, who became a bankrupt before the commencement of
this section.
