BOUNTY (SHIPS) AMENDMENT ACT 1985 No. 76 of 1985 - SECT 18

18. After section 17 of the Principal Act the following sections are inserted:
Time for prosecutions

"17A. A prosecution for an offence against this Act may be commenced at any
time within 3 years after the commission of the offence. Recovery of bounty on
conviction

"17B. (1) Where a person is convicted before a court of an offence against
sub-section 9B (1) or 17 (2) or (3), the court may, in addition to imposing a
penalty on the person, order the person to pay to the Commonwealth an amount
not exceeding the amount of bounty wrongfully obtained by the person.

"(2) Where-

   (a)  under sub-section (1), a court orders a person to pay an amount to the
        Commonwealth; and

   (b)  the court has civil jurisdiction to the extent of the amount, the
        order is enforceable in all respects as a final judgment of the court
        in favour of the Commonwealth.

"(3) Where-

   (a)  under sub-section (1), a court orders a person to pay an amount to the
        Commonwealth; and

   (b)  the court-

        (i)    does not have civil jurisdiction; or

        (ii)   has civil jurisdiction, but-

                (A)  does not have civil jurisdiction to the extent of the
                     amount; or

                (B)  it is more appropriate for the order to be enforceable as
                     a final judgment of another court, the proper officer of
                     the court shall issue to the Comptroller-General a
                     certificate in the prescribed form containing the
                     prescribed particulars.

"(4) The certificate may, in the prescribed manner and subject to the
prescribed conditions (if any), be registered in a court having civil
jurisdiction to the extent of the amount ordered to be paid to the
Commonwealth.

"(5) Upon registration under sub-section (4), the certificate is enforceable
in all respects as a final judgment of the court in favour of the
Commonwealth.

"(6) The costs of registration of the certificate and other proceedings under
this section shall, subject to the prescribed conditions (if any), be deemed
to be payable under the certificate.

"(7) In sub-section (1), 'bounty' includes an advance on account of bounty
under section 8.".
