BROADCASTING (OWNERSHIP AND CONTROL) ACT 1988 No. 56 of 1988 - SECT 7

7. (1) Section 90F of the Principal Act is amended by omitting subsection (1)
and substituting the following subsections:

"(1) A person contravenes this section if and so long as the person is a
director of 2 or more companies that are, between them, in a position to
exercise control of each of 17 or more commercial radio licences.

"(1AA) A person contravenes this section if and so long as the person is a
director of 2 or more companies that are, between them, in a position to
exercise control of each of 2 or more metropolitan commercial radio licences
in the same State.".

(2) Section 90F of the Principal Act is amended by omitting subsection (1AA)
and substituting the following subsections:

"(1AA) A person contravenes this section if and so long as the person is a
director of 2 or more companies that are, between them, in a position to
exercise control of each of a pair of commercial radio licences that has a
substantial market in common.

"(1AB) A person contravenes this section if and so long as the person is a
director of 2 or more companies that are, between them, in a position to
exercise control of each of a number of commercial radio licences in a State
exceeding the maximum number of commercial radio licences in the State that a
person is permitted to hold.".
