CORPORATIONS ACT 1989 No. 109 of 1989 - SECT 1260

False trading and market rigging
1260. (1) Where a person:

   (a)  creates, or causes to be created, or does anything that is calculated
        to create, a false or misleading appearance:

        (i)    of active dealing in futures contracts on a futures market in
               Australia; or

        (ii)   with respect to the market for, or the price for dealings in,
               futures contracts on a futures market in Australia; or

   (b)  by any fictitious or artificial transactions or devices, maintains,
        inflates, depresses or causes fluctuations in, the price for dealings
        in futures contracts on a futures market in Australia; each of
        subsections (2), (3), (4) and (5) has effect without prejudice to any
        of the others.

(2) If the person is a corporation, the person contravenes this section.

(3) If the futures market is an eligible futures market, the person
contravenes this section.

(4) If the dealings referred to in subparagraph (1) (a) (ii) or paragraph (1)
(b) are or include dealings by or on behalf of corporations, the person
contravenes this section.

(5) If the dealings referred to in subparagraph (1) (a) (ii) or paragraph (1)
(b) are or include dealings in eligible circumstances, the person contravenes
this section.

(6) For the purpose of determining whether a transaction is fictitious or
artificial within the meaning of paragraph (1) (b), the fact that the
transaction is, or was at any time, intended by the parties who entered into
it to have effect according to its terms shall not be conclusive.
