CORPORATIONS ACT 1989 No. 109 of 1989 - SECT 128

128. Subject to Division 6, the Commission shall grant an application under
this Division if, and only if:

   (a)  the application was made in accordance with section 127; and

   (b)  the Commission is satisfied that:

        (i)    the applicant is not an externally-administered body corporate;
               and

        (ii)   the applicant's name is reserved in respect of it under
               section  374.
