CORPORATIONS ACT 1989 No. 109 of 1989 - SECT 688

688. (1) For the purposes of the application of this Division in relation to a
listed company, a person is, at a relevant time, a prescribed person in
relation to a period that is, because of the service of a Part A statement or
the making of a takeover announcement, a relevant period in relation to the
company if:

   (a)  the person is, or is one of the persons who constitute, the offeror;
        or

   (b)  the person is, at that time, entitled to more than the notifiable
        percentage of the voting shares in the company and is not, and is not
        an associate of, a person referred to in paragraph (a).

(2) For the purposes of paragraph (1) (b), the notifiable percentage is 5% or,
if a lesser percentage is prescribed by regulations in force for the time
being for the purposes of that paragraph, that lesser percentage.
