CORPORATIONS ACT 2001 No. 50, 2001 - SECT 1097A

Quoted securities and rights

(1) A quoted security is a marketable security in a class of marketable securities listed for quotation on a stock market of a securities exchange. (2) A quoted right is a marketable right in a class of marketable rights listed for quotation on a stock market of a securities exchange. (3) For the purposes of subsections (1) and (2), securities or rights in a class of marketable securities or marketable rights are not taken to have stopped being listed for quotation on a stock market of a securities exchange merely because of a temporary suspension of quotation of securities or rights in that class. (4) If:

(a)
there is a suspension of the quotation, on a stock market of a securities exchange, of marketable securities in a class of marketable securities, or of marketable rights in a class of marketable rights; and

(b)
during the suspension, the issuing body in relation to the securities or rights ceases to be included in an official list of the securities exchange;

then, for the purposes of subsections (1) and (2), marketable securities or marketable rights in that class are taken to stop being listed for quotation on a stock market of the securities exchange when the issuing body ceases to be so included.

(5) Subsection (4) does not limit the circumstances in which marketable securities in a class of marketable securities, or marketable rights in a class of marketable rights, may be taken to have stopped being listed for quotation on a stock market of a securities exchange.
