CORPORATIONS ACT 2001 - SECT 272

Certificates

(1) Where particulars of a charge are entered in the Register in accordance with this Part, ASIC must, on request by any person, issue to that person a certificate under the common seal of ASIC setting out those particulars and stating the time and day when a notice in respect of the charge containing those particulars was lodged with ASIC and, if the word "provisional" appears in the Register in relation to the reference to that time and day, stating that fact. (2) A certificate issued under subsection (1) is prima facie evidence of the matters stated in the certificate. (3) Where particulars of a charge are entered in the Register in accordance with this Part, and the word "provisional" does not appear in the register in relation to the reference to the time and day when a notice in respect of the charge was lodged, ASIC must, on request by any person, issue to that person a certificate under the common seal of ASIC stating that particulars of the charge are entered in the Register in accordance with this Part. (4) A certificate issued under subsection 272(3) is conclusive evidence that the requirements of Part 2K.2 as to registration (other than the requirements relating to the period after the creation of the charge within which notice in respect of the charge is required to be lodged) have been complied with.
