CHILD CARE PAYMENTS ACT 1997 No. 195 of 1997 - SECT 10
Extended meaning of inhabitant of Australia--hardship and special circumstances
(1) A person is an inhabitant of Australia if the Secretary determines in
writing that the person is an inhabitant of Australia for the purposes of this
Act.
(2) The Secretary may make a determination under subsection (1) if the
Secretary is satisfied that:
(a) hardship would be caused to the applicant if
the applicant were not treated as an inhabitant of Australia; or
(b) because of the special circumstances of the particular case, the
applicant should be treated as an inhabitant of Australia.
(3) In making a determination under subsection (1), the Secretary must comply
with any guidelines in force under subsection (4) in relation to the making of
such declarations.
(4) The Minister may, by determination in writing, make guidelines relating to
the making of determinations under subsection (1).
(5) A determination under subsection (4) is a disallowable instrument for the
purposes of section 46A of the Acts Interpretation Act 1901 .
