CHILD CARE PAYMENTS ACT 1997 No. 195 of 1997 - SECT 127
Secretary may require person to give information relating to entitlement to child care rebate in a past period
(1) The Secretary may give the person a notice that requires the person to
give the Department * information about specified matters relating to the
person's entitlement to be paid child care rebate, or the rate at which child
care rebate was payable to the person, in respect of a specified past period.
(2) The notice may also require the person to produce evidence of liabilities
of a kind referred to in paragraph 78(2)(d) incurred in respect of the period.
(3) Subject to subsection (4), the notice:
(a) must be in writing; and
(b) may be given personally or by post; and
(c) must specify how the * information or evidence is to be given to the
Department; and
(d) must specify the period within which the person is to give the
information or evidence to the Department; and
(e) must specify that the notice is a recipient reconciliation notice
given under this Act.
(4) The notice is not invalid merely because it fails to comply with paragraph
(3)(c) or (e).
(5) The period specified under paragraph (3)(d) must end at least 14 days
after the day on which the notice is given.
(6) The person commits an offence if the person refuses or fails to comply
with the notice.
Penalty: 30 penalty units.
