CHILD CARE PAYMENTS ACT 1997 No. 195 of 1997 - SECT 21
Meaning of dependent child
(1) A child is a dependent child of another person for the purposes of child
care assistance if:
(a) the child is a dependent child of the person for the
purposes of Part 2.17 of the Social Security Act 1991 ; or
(b) a determination by the Secretary under subsection (2) is in force in
relation to the child and the person.
(2) The Secretary may determine in writing that, because of special
circumstances, a child is to be treated as a dependent child of another person
for the purposes of child care assistance.
