CHILD CARE PAYMENTS ACT 1997 No. 195 of 1997 - SECT 265
Review of SSAT decision on application by the Secretary
(1) If a decision has been reviewed by the SSAT and has been varied or set
aside, the Administrative Appeals Tribunal Act 1975 applies to a review under
section 263 of the SSAT's decision as if the Secretary were, for the purposes
of section 27 of that Act, a person whose interests are affected by the SSAT's
decision.
Note: Section 27 of the Administrative Appeals Tribunal Act 1975
provides that, if an Act provides that an application may be made to the AAT
for a review of a decision, the application may be made by or on behalf of any
person whose interests are affected by the decision.
(2) If the decision reviewed by the SSAT was made by the * CEO or an *
employee of the * Agency, subsection (1) applies as if the reference to the
Secretary were a reference to the CEO.
