CHILD CARE PAYMENTS ACT 1997 No. 195 of 1997 - SECT 274
Power of the AAT if party fails to appear
The Administrative Appeals Tribunal Act 1975 applies to a review under
section 263 as if the reference in subsection 42A(2) of that Act to the person
who made the decision were a reference to the Secretary.
Note:
Subsection 42A(2) of the Administrative Appeals Tribunal Act 1975 empowers the
AAT to direct that, if a person fails to appear (other than the person who
made the decision that is under review), that person is to cease to be a party
to the proceedings before the AAT or the application for review is to be
dismissed.
