Commonwealth Electoral Legislation Amendment Act 1983 No. 144 of 1983 - SECT 66

Inspections of applications

66. Section 89 of the Principal Act is amended-

   (a)  by omitting sub-sections (1) and (2) and substituting the following
        sub-sections:

''(1) Where an application for a postal vote certificate and postal
ballot-papers is received by the Divisional Returning Officer for the Division
to which the application relates, the Divisional Returning Officer shall, upon
the issue of a postal vote certificate and postal ballot-paper to the elector
making the application-

   (a)  in a case where the application is a written application-indorse the
        date of issue on the application; or

   (b)  in a case where the application is an oral application-make a record
        of the issue of the postal vote certificate and postal ballot-paper to
        the elector making the application, of the date of the issue and of
        the number of the postal vote certificate so issued.

''(2) Where an application for a postal vote certificate and postal
ballot-paper is received by-

   (a)  a Divisional Returning Officer for a Division other than the Division
        to which the application relates;

   (b)  a postal voting officer;

   (c)  an Assistant Returning Officer at a place outside Australia,

the officer shall, upon the issue of a postal vote certificate and postal
ballot-paper to the elector making the application-

   (d)  in a case where the application is a written application-indorse the
        date of issue of the postal vote certificate and postal ballot-paper
        on the application and send the application to the Divisional
        Returning Officer for the Division to which it relates; or

   (e)  in a case where the application is an oral application-give notice in
        writing to the Divisional Returning Officer for the Division to which
        the application relates of the issue of the postal vote certificate
        and postal ballot-paper to the elector making the application, of the
        date of the issue and of the number of the postal vote certificate so
        issued.'';

         (b)  by inserting in sub-section (3) ''written'' after ''All''; and


   (c)  by inserting in sub-section (3) '', records made in pursuance of
paragraph (1) (b) and notices given in pursuance of paragraph (2) (e)'' after
''ballot-papers''.
